wads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said

FO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 ofthe Lien Law~ covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to he applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any pa~ of the total of
the same for any other purpose. The word "patty" shall he constn~l as if it read "parties" whenever the
~nse of this indenture so requires.

'ALL that certain plot, piece or parcel of land situate lying and being at Bayview,
in the Town of Southold, County of Suffolk and State of New York, known and
designated as Lot No. 42 on a certain map entitled, "Leeward Acres at Bayview",
filed in the Office of the Clerk of the County of Suffolk on June 4, 1971 as Map
No.. 5599 which said lot is more particularly bounded and described a,~ follows:
BEGINNING at a point on the westerly side of Topsail Lane distance 375.00 feet
southerly from the extreme southerly end of a curve which connects the westerly
side of Topsail Lane with the southerly side of North Bayview Road;
RUNNING THENCE Southerly along the westerly side of Topsail Lane, South 17
degrees 00 minutes 30 seconds West; 174.10 feet;
THENCE North 72 degrees 59 minutes 30 seconds West 229.83 feet;
THENCE North 16 degrees 57 minutes 10 seconds East, 173.88 feet;
THENCE South 73 degrees 02 minutes 50 seconds East, 230.00 feet to the
westedy side of Topsail Lane, the point or place of BEGINNING.
TOGETHER with an undivided one fifty-third (1153rd) interest in lands shown and
designated as "Park, Recreation and Drainage Area~, on the Map of Leeward
Acres at Bayview, filed in the Office of the Clerk of the County of Suffolk on June
4, 1971, as Map No. 5599.
