THIS INDENTURE, made then dey-of,October, nineteen hundred and ninety seven
BETWEEN ACMT Equities, Inc., a domestic corporation, with offices located at 1138
William Floyd Parkway, Shirley, New York, party of the first part, and
UI� Francis W. Everett and Cathie Everett, his wife, 2315 Gabriella Court, Mattituck, New
York, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Teh Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
f` erected, situate, lying and being at Mattituck, in the Town of Southold, County of Suffolk
and State of New York, known and designated as Lot 5 on a certain map entitled, "Map
of Elijah's Lane Estates, Section 3" filed in the Suffolk County Clerk's Office on 10-8-96
as Map Number 9913.
BEGINNING at a point on the southerly side of Gabriella Court distant 398.19 feet west,

southerly side of Gabriella Court and the northwesterly side of Tabor Road, said point of
beginning also being at the division line between Lot 5 and Lot 6 as shown on said

west 264.45 feet to the land now or formerly of Agnes Grabowski;
RUNNING THENCE along said land the following two courses and distances:

(2) north 34 degrees 42 minutes 50 seconds west 146.03 feet to the southerly side of

(1) easterly along an arc of a curve with a radius of 50.00 feet a distance of 42.05 feet;
(2) easterly along an arc of a curve with a radius of 25.00 feet a distance of 21.03 feet;
(3) south 37 degrees 40 minutes 40 seconds east 100.37 feet to the point or place of
BEGINNING.

BEING AN INTENDED to be the same premises conveyed to the party of th/e first party,�"'�'�?�

TOGETHER WITH all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to the said premises; TO HAVE AND TO HOLD the said premises granted
unto the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any whatever,
