WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and beingiAbe at Mattituck, in the Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a point on the northerly line of land now of formerly of Arthur
H. Penny distant 351.60 feet on a course North 70 degrees 45 minutes 00 seconds
East and when measured along said northerly side of land now or formerly of Arthur
H. Penny, and along the northerly side of land now or formerly of Minnie Schutt
from a point on the northeasterly side of Westphalia Avenue, from said point
of beginning.
RUNNING THENCE along land now or formerly of Mabel L. Bubier North 19 degrees
43 minutes 40 seconds West 600.58 feet to the shore of Mapes Creek;
RUNNING THENCE along the shore of Mapes Creek on a tie line of North 82 degrees
15 minutes 40 seconds East 110 feet;
RUNNING THENCE South 18 degrees 50 minutes 30 seconds East 587.61 feet to said
northerly line of land now or formerly of Arthur H. Penny;
RUNNING THENCE along said last mentioned land South 70 degrees 45 minutes 00
seconds West 100 feet to the point or place of BEGINNING.
SUBJECT to and together with the benefits of an easement or right of way 15
feet in width running from premises adjoining on the east of Westphalia Road
as created by deeds made by Lizzie Y. Meday recorded in Liber 984 page 99 as
modified by agreement between Stephen C. Dubier and Ruth Sloan Gimbernat dated
April 25, 1966 and recorded in Suffolk County Clerk's Office on August 25, 1972
in Liber 7227 page 470.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first
TAX MAP part by deed recorded in Suffolk County Clerk's Office on May 4, 1987 in Liber
-ESIGNATION 9352 Page 446.
"t. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
1000 roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO

whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
