New York 11971. JOHN L HURTADO, SR., residing at 3400 Lighthouse Road, Seuthold, New York
11971, and JOHN L. HURTADO, JR., residing at 21 Astor Avenue, St. James, New York 11780. party
of the first part, and
MCM HOMES, INC., a New York corporation with offices at 6 Cherry Lane, Mt. Sinai, New York 11766,
party of the second part,
WiTNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.00)--Dollars. and
oth&r good and valuable coneideraUon paid by the party of the second part, does hereby grant ~ release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, County of
Suffolk and State of New York, known as Red Fawn Road on 'Map of Forostbrook at Bayvlew' Southold,
New York, and filed in the Office of the Clerk of the Cou _r? of Suffolk on June 15, 2004 as Map Number
11119, '
The party of the second part hereby agrees to complete the subdivision and road improvements in
accordance with the Agreement on Road Dedication dated October 6, 2004 and requirements of the Town
of Southold. Reserving to the party of the first part the right to dedicate the road to the Town of Southold
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid,
AND the party of the first part. in compliance with Section 13 of the Uen Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word 'party' shall be construed as if it read 'parties' whenever the
sense of this indenture so requires.
