the second part,
WFFNESSETH, that the party of the first part, in consideratk)n of Ten and 00/100

and other good and valuable consideration paid by the party of the second part. does hereby grant and
release unto the party of the second part, the heirs o~ successors and as,,igna of the party of the second part
forever.
All that certain plot, piece or parcel of land, situate, lying end being in the Town of Southoid, County'of Suffolk
and State of New York, known and designated as Lot 3 as shown on a certain map entitled, 'Map of
Forestbrook at Bayyiew' and filed in the Office of the Suffolk County Clerk on June 15. 2004 as Map No.
11119, said lit being more particularly bounded and described as foilow~:
BEGINNING at a paint on the eestady side of Red F~wn Road where the same is intemected by the division
line between Lots 2 and 3 as shown on the aforesaid map. said point or place of beginning being di.stant
509.31 feet northerly as measured along the easterly side of Red Fawn Road from the northerly end of a curve
which curve connects the northerly side of North Bayvtew Road with the ea~tady aide of Red Fawn Road;
Running thence from said point or place of beginning along the easterly and no~lhassterly side of Red Fawn
Road in a northerly and northwesterly direction along the arc of a curve beadng to the left having a radius of
60.00 feet a distanea of 65.28 feet to the division line between Lots 3 and 4;
Running thence along said division line, No~th 18 degrees 21 minutes 24 seconds East, 292.00 feet to the
division line between Lots 3 and 7:
Running thence along said division line in a southeasterly direction along the arc of a curve beadng to the right
having e radius of 352.00 feet a distance of 382.96 feet to the clivlalin line between Lots 2 and 3; and
Thence along said division line, South 80 degrees 41 minutas 29 seconds West. 292.00 feet to the easterly
side Of Red Fawn Read, the point or pl~ce of BEGINNING.
BEING AND INTENDED TO BE part of the same premises conveyed to the party of the first part by deed
dated 11112J03, recorded 2/6/04 in Liber 12299 page 879.
TOGETHER with all right, title and interest, if any, of the party of the first part In and to any streets end roads
abutting the above deso~tbed premises to the center lines thereof;, TOGETHER with the appurtenances and all
! the estate and dghts of the party of the first part in and to said premlsa~; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
flint part will receive the consideration for this conveyance end Will hold the right to receive such consideration
es a trust fond to be applied first for the purpose of paying the _c,~__! of the improvement and Will apply the sams
first to the payment of the cost of the impeT)vement before using any part of the total of the same for any ether
purpose. The word "party' shall be construed as if It read 'parties' when ever the sense of this indenture so
requires.
