BEING AND INTENDED TO BE the same premises conveyed to the part}' of the first part by deed
dated March 28, 1994 recorded in the Suffolk County Clerk's Office on April 14, 1994 in Liber 11672
at page 576.
TOGETIIER with all right, title and interest, if any. of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereol:
TOGETllER with the appurtenances and all the estate and rights ofthe party of the first part in and to said
premises. . .
TO [lAVE AND TO HOLD the premises herein granted unto the party of thc second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the l,ien Law: covenants that the party
of the first part will receive the coltsideration for this conveyance and will hold the fight to receive such
consideration as a trust fia~d to be applied first for the purpose of paying the cost of the improvement, and
will apply thc same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.

ALI. THAT CERTAIN PLOT, piece or parcel of land, situate, lying and being in the Town of
Southold, County of Suffolk and State of New York, more particularly bounded and described as follows:
BEGINNING at a point on the westerly side of North Road to Bayview (which point is the
southeasterly comer of the premises herein described and the northeasterly comer of land heretofore
conveyed to Cheryl Ann McCabe by deed dated September 23, 1982 and recorded in the Suffolk County
Clerk's Office on September 23, 1982 in Liber 9246 of deeds at page 101);
RUNNING THENCE along said land of Cheryl Ann McCabe North 68 degrees 50 minutes 00
seconds West 225.0 feet to land now or formerly of Dougherty and others;
RUNNING THENCE along said land now or formerly of Dougherty and others North 21 degrees 10
minutes 00 seconds East 244.0 feet to a point marked by a monument and other land of Joscph A. Shipule;
RUNNING TI-IENCE along said other land of Joseph A. Shipule South 68 degrees, 50 minutes 00
seconds East 225.0 feet to a point marked by a monument on the westerly side of North Road to Bayview;
RUNNING THENCE along said westerly side of North Road to Bayview South 21 deglxes 10
minutes 00 seconds West 244.0 feet to the point or place of BEGINNING.
