WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, at Bayview, Suffolk County, New York,
D06 more particularly shown and designated as Lots Number 13 and 14 on
a certain map entitled "Map of Bayside Terrace" and filed in the
0 7 DLID Suffolk County Clerk' s Office on March 11, 1953 as Map. No. 2034 .
Together with the right to use, in common with others, as determined
Q v a by the party of the first part, and only for the benefit of the
ala 0 0 D premises described, for ingress and egress only, to Goose Creek, a
strip of land at Bayview, Town of Southold, Suffolk County, New
61 2) p 0a York, 20 feet in width, bounded northeasterly about 240 feet by
Waterview Drive as it extends northwesterly to Goose Creek, south-
easterly by Waterview Drive 20 feet, southwesterly by lands now or
formerly of Eastern Suffolk Realty Inc. , about 240 feet, and north-
westerly by Goose Creek. I
Together with a right of way for ingress and egress and for public '
utilities over the streets shown on said map, to the nearest public
highway.
As to Lot Number 13, being and intended to be premises conveyed to
the party of the first part by deed dated July 22 , 1969, and re-
corded in the Suffolk County Clerk' s Office on January 8 , 1971
in Liber 6866, page 568.
As to Lot Number 14, being and intended to be the same premises con-
veyed to the party of the first part by deed dated December 1 , 1983,
recorded in the Suffolk County Clerk' s Office on January 31, 1984 in
Liber 9504 , page 530.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply-
`� the same first to the payment of the cost of the improvement before using any part of the total of the same for
\ any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture 5o requires.
