It is generally rectangular in shape with 720±' of frontage on the northerly side of North Road (C.R. 48) and has a depth of approximately 1,9001. The above dimensions are taken from the Suffolk County Tax Map and a survey of the subject prepared by Peconic Surveyors, PC. We have included a copy of the Tax Map in the addenda to this report. Utilities (electric and telephone) are available along the property's road frontage. • North Road (C.R. 48) is a two way, two lane, publicly maintained macadam paved road with shoulders. The property has a generally level topography and is mostly cleared. It is situated at or near road grade. The northerly"third" of the property is bisected by an east- west running right of way easement which benefits the Long Island Power Authority and is used for overhead electrical power lines. Doroski application - Bob Jenkins showed the Committee a survey map of the property. The property goes from Route 48 to Soundview Avenue. They will keep out approximately 6 acres, which is wooded. A motion was made by Ray Huntington and seconded by Noreen McKenna to have an appraisal done on this parcel. All were in favor. E • N v I R O N M E N • T A L S U M M A R • Y '• Phase I Environmental Site Assessment •Doroski Property 1_0 SUMMARY The subject property has been inspected and reviewed independently by Nelson, Pope & Voorhis, LLC in order determine if potential environmental or public health concerns are present. This report is intended to identify Recognized Environmental Conditions (as defined in ASTM Standards on Environmental Site Assessments for Commercial Real Estate) on the subject property based on the four (4) basic components of a Full Phase I Environmental Site Assessment (ESA): records review, site reconnaissance, interviews and evaluation and reporting. The subject property lies in the Hamlet of Southold, Town of Southold, County of Suffolk, New York. The subject property is a 39.7 acre parcel of farmland and woods. The property is located ' on the north side of Middle Road (Route 48), west of Kenney Road. The property is more particularly described as Suffolk County Tax Map # 1000-069-01-9. The majority of the 39.7 acre parcel of farmland with an area of wooded land on the northern quarter of the property. An inspection of the property did not reveal any major dumping or ' debris, staining, residue, odors or stressed vegetation. Aerial photographs from 1960, 1969 1976, 1980 and 1994 identified the subject property as farmland and vacant wooded land during this period. ' An extensive government records search found no potential sources of environmental degradation on the subject property. No Federal, State and County documented regulated sites ' were noted in the vicinity of the subject property. In conclusion, this assessment has revealed no evidence of recognized environmental conditions in connection with the subject property, subject to the methodology and limitations of this report. You earned them. • RICHARD RYAN: We have with us tonight the members of the Doroski Family Limited Partnership, Bob Jenkins and his wife, Joan, and Ted Szczotka, and his wife Barbara. This hearing has to do with the offer of development rights by the Doroski Family Limited Partnership for the Tax Map #1000-069-01-009. My name is Dick Ryan. I serve as your Chairman of the Town Land Preservation Committee, and I have asked Melissa Spiro, our Land Preservation Coordinator if she would point to some of these things that might be highlighted here in my presentation. This map was produced through the best efforts of our Coordinator and the GEIS, John Sep in his office, and it makes a great visual, I think, to help explain what we have got going here. The subject farm parcel is approximately 40 acres in size. It has frontage on both the north side of County Route 48, the Middle Road, and south side of Soundview Avenue. The farm is split zoned, Agricultural Conservation, and Residential Low Density, which permits single family residential development on two acre plots, but also intends to control development of open land, that are agriculturally productive. The mostly Haven Loam soil classification of this farm reflects it high agricultural productivity. Most of the parcel is currently in production used for potatoes. The owner proposes to reserve about six acres of the wooded northernmost area from the proposed development rights easement. This farm parcel represents a link in a chain in agricultural land parcels along the Middle Road that the Town and the County, Suffolk County Farmland Preservation Programs have identified for possible purchase and preservation. This property is presently a participant parcel in the Suffolk County Agricultural District #1, which assures agricultural use for a period of years in exchange for a reduction in real property taxes. The preservation of this particularly farmland parcel will serve to enhance efforts at • consolidating large blocks of important productive agricultural land in the town. Suffolk County now owns development rights easements to about 27 contiguous acres adjacent to and on the east of this,'farm. If people know where the Mudd Vineyard parcel that is just adjacent to this property. The purchase will expand and assure a significant agricultural open space vista along the northerly side of the Middle Road. The Southold Town Planning Board has been consulted and expressed no reservation to the proposed purchase. The negotiated purchase price if$12,000 an acres for the approximate 34 acres of development rights totally about $400,000. No development rights value is ascribed to that portion of the proposed easement area encumbered by an existing LIPA easement, this is where the high tension transmission lines across the town travel, and they bisect this property. The market value of the proposed purchase reflects in part the development potential, and the location of the property. The value of the proposed purchase is supported by a recent appraisal independently prepared by Given Associates of Hauppauge. A survey of the parcel is to be accomplished. The survey and the purchase agreement should be subject to adoption by the Land Preservation Committee prior to any completion or this purchase if this Town Board so resolve. The farm parcel is identified in the Town's 75% funding reimbursement application presently before the New York State Department of Agriculture and Markets. Because of it's agricultural value it's location on County Route 48, and its proximity to other existing productive farmland the property has a high illegibility for preservation. The Land Preservation Committee members are unanimous in recommending this development rights purchase. The purchase will most certainly preserve and continue a rural character element of the Middle Road corridor in the hamlet of Southold, specifically in the Town in general. On behalf of the Land Preservation Committee I urge the Town Board to accept the offer of development • rights to approximately 34 acres of this farm subject to the receipt of the approved survey, and to PH 3 resolve to purchase the same pursuant to the provisions of either Chapter 6 of the Community • Preservation Fund, or Chapter 25, the Agricultural Land Preservation Section of the Town Code, and to further resolve that the purchase transaction may be accomplished under the auspices of the Suffolk County Green Ways Program, or the Suffolk County Partnership Program as deemed appropriate by the Supervisor, and further to resolve that the purchase transaction is to be accomplished by the joint coordinator efforts of our Town Attorney and Land Preservation Coordinator. As a condition of approval by the PLANNING BOARD of the • conservation subdivision, the DECLARANT covenants that on lots 1 through 3 clearing shall be limited to the following: lot one is limited to 35% of the total lot size; lot two is limited to 25% of the total lot size; lot 3 is limited to 25% of the total lot size . 5 . The location of the clearing shall be at the discretion of the owner as long as the aggregate land area cleared does not exceed the limit of clearing. The limitation on clearing and cutting shall not prohibit the proper landscaping and maintenance of the vegetation, including but not limited to removal of diseased, decayed or dead material and obnoxious plant species . Specifically permitted throughout the entire property is the planting of additional native plants, or replacing trees and other vegetation with comparable native species. 6 _ The lots are located adjacent to an agricultural reserve and these lots may be subject to the noise and fugitive dust normally associated with agricultural activities. Farming practices and activities are protected pursuant to Article XXII, Farmland Bill of Rights [Added 5-27-1997 by L.L. No . 11-19973 Section 100-220 . Right to Farm of the Town of Southold Town Code. • 7 . No new residential structure (exclusive of driveway and dry wells) or sanitary disposal facility shall be constructed or otherwise located less than 100 feet from the most landward limit of freshwater wetland. 8 . No stormwater runoff resulting from development and improvement of the subdivision or any of its lots shall be discharged into the freshwater wetlands on site. 9 . A conservation or scenic easement having a minimum width of 75 feet shall be established landward of the edge of freshwater wetland vegetation. Such clearing and cutting within the 75 feet shall be subject to review by the Town of Southold to insure proper maintenance and preservation of the natural buffer. 10 . All stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retianed on the site by adequate drainage structures so that it will not flow out onto the right-of-way of CR 48 . 11 . All of the covenants and restrictions contained herein shall be construed to be in addition to and not in derogation or limitation upon any provisions of local, • state, and federal laws, ordinances, and/or regulations in effect at the time of execution of this agreement, or at the time such laws, ordinances, and/or regulations may thereafter be revised, amended, or promulgated. 12 . The aforementioned Restrictive Covenants shall be enforceable by the Town of Southold, State of New York, by injunctive relief or my any other remedy in equity or at law.
