COUNCILMAN WICKHAM: NOTICE IS HEREBY GIVEN, there has been
presented to the Town Board of the Town of Southold, Suffolk County, New York, on
the 12th day of August, 2008 a Local Law entitled "A Local Law in relation to the 2008
Town of Southold Community Preservation Fund Management and Stewardship
Plan" and
NOTICE IS HEREBY FURTHER GIVEN that the Town Board of the Town of
Southold will hold a public hearing on the aforesaid Local Law at the Southold Town
Hall, 53095 Main Road, Southold, New York, on the 9th day of September, 2008 at 7:45
p.m. at which time all interested persons will be given an opportunity to be heard.
The proposed Local Law entitled, "A Local Law in relation to the 2008 Town of
Southold Communit~ Preservation Fund Management and Stewardship Plan" reads
as follows:

A Local Law entitled, "A Local Law in relation to the 2008 Town of Southold
Community Preservation Fund Management and Stewardship Plan".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose - In compliance with the recently-enacted New York State legislation
relating to Peconic Bay Community Preservation Fund Administration Reforms, the Land
Preservation Department has prepared a 2008 Management and Stewardship Plan for real
property interests acquired through the fund. This plan must be adopted by local law and

all expenditures from the fund for management and stewardship functions must be in
compliance with the terms of the plan.
II. Chapter 17 of the Code of the Town of Southold is hereby amended as follows:

Community Preservation Fund Management and Stewardship Plan
A. The Town Board of the Town of Southold hereby approves and adopts the
Community Preservation Management and Stewardship Plan for real property interests
acquired by use of moneys from the Town of Southold Community Preservation Fund,
prepared by the Land Preservation Department and Land Preservation Committee, for the
period July 1, 2008 through December 31, 2008, presented to the Town Board during the
Work Session of August 12, 2008, and intended to be the management and stewardship
plan required by amendments to § 64-e of the New York State Town Law.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by
any court of competent jurisdiction to be invalid, the judgment shall not affect the
validity of this law as a whole or any part thereof other than the part so decided to be
unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as
provided by law.
NOTE: The plan is' available at the Town Clerk's Office, the Town's website
(southoldtown. north fork. net), and the Land Preservation Office.
I have a notice that this has appeared as a legal in the local newspaper, a classified and it
has appeared on the Town Clerk's bulletin board outside. There is a note from the
LWRP coordinator, who is recommending on September 8th by saying 'it is my
recommendation that the proposed action is consistent with the policy standards and
therefore is consistent with the LWRP.' Them is a short environmental assessment form,
filled out and signed and that is the sum total of what we have in the file.
SUPERVISOR RUSSELL: Would anybody like to come up and address the Town
Board on this particular local law? Melissa?
MELISSA SPIRO, LAND PRESERVATION COORDINATOR: Melissa Spiro, Land
Preservation Coordinator. Councilman Wickham pretty much summarized what this is, it
is a new change to the law, the 2% law that requires a stewardship plan. We prepared a
plan just to the end of 2008. We will be doing another one for 2009 and having another
hearing and local law for that particular one. Basically there is no new cost to the town

with this plan because all of the costs were already adopted in the current 2008 budget.
The Town Board already went through their budget hearings in 2007 and so there is no
new costs. What we have done is listed all of the projects that we will be working on, the
stewardship project that we will be working on on community preservation projects
through the end of 2008.
SUPERVISOR RUSSELL: Thank you.
PETER TERRANOVA: Does this change have to do with where the money for or the
resources for the management and the stewardship of the acquired lands come from as
opposed, you know, does it come from the fund or does it come from general tax
revenues?
SUPERVISOR RUSSELL: It comes from the fund. Melissa will...
MS. SPIRO: It is coming from the fund. It is all budgeted, the current 2008 budget is the
money, the funds that we are using from the community preservation fund.
MR. TERRANOVA: Right, I understand that but going forward, I thought I read
something about that the adoption of this new law that is being required by the state,
okay, where formally the funds for the management and stewardship of the land you
acquired was coming out of the land preservation fund. Is that still going to be allowed
or does that money then have to come out of....
COUNCILMAN WICKHAM: It will be allowed pursuant to this plan that we are about
to adopt.
COUNCILMAN KRUPSKI: You have to now have a plan in order to spend that money,
an approved plan in order to spend that money. Whereas before you could just spend a
certain percentage of it without having a specific approved plan.
MR. TERRANOVA: And what is the difference?
SUPERVISOR RUSSELL: Transparency.
COUNCILMAN WICKHAM: The plan would give greater discipline and specificity
to...
JUSTICE EVANS: You can only spend it on what is in the plan.
MR. TERRANOVA: So you need a budget?
SUPERVISOR RUSSELL: Yes. What the difference is, Peter Terranova Peconic. Not
Terramello. Terranova. What it is, it is about transparency. It is about putting up in
advance to the public what our intended uses are for that fund and for the land that we

I. INTRODUCTION
On July 23, 2008, Governor Paterson signed A.10724/S.811 into law. This
legislation enacted into law administrative reforms to the Peconic Bay
Community Preservation Fund. The legislation became effective immediately as
of July 23, 2008.
One of the amendments to the law provides that each town may establish a
management and stewardship plan for lands acquired by the fund. The revised
New York State Town Law Section 64-e 6 reads as follows:
"As part of, or in addition, to said Community Preservation Fund Project
Plan, each Town Board may also adopt a Management and Stewardship
Plan of interests or rights in real property acquired pursuant to this
Section. No monies from the fund shall be expended for management and
stewardship, except as approved in said Plan. Said Plan may provide
management and stewardship projects for up to a three year period and
shall provide a description and estimated cost for each project. Said Plan
shall be approved and adopted by Local Law and may be updated from
time to time at the discretion of the Town Board. Only management and
stewardship projects permitted pursuant to Subdivision Nine-A of this
section shall be eligible to be included in the Plan."
This Community Preservation Fund Management and Stewardship Plan (CPF
Stewardship Plan) identifies how Southold Town will expend monies from the
Community Preservation Fund for management and stewardship for the period
of July 1, 2008 - December 31, 2008.
On November 20, 2007, the Town Board adopted the Town Budget for FY2008.
The Town Budget includes an Expenditure Budget for the Community
Preservation Fund. Since the revised CPF legislation was adopted after the
Town Board adopted the FY2008 Town Budget, the CPF Stewardship Plan is
retroactive to the existing Expenditure Budget for the Community Preservation
Fund from the Town Board approved FY2008 budget.

Additional details for specific line items are described below and within CPF
Stewardship Plan Attachment A. CPF Stewardship Plan Attachment A lists all
open space properties acquired with Community Preservation Funds and notes
projects and cost estimates for FY2008 for each property. The list does not
include agricultural easements acquired with Community Preservation Funds.
When the Town purchases agricultural easements, the landowner remains the
steward of the land. The Town performs yearly monitoring of agricultural
easements. During FY2008 monitoring is to be performed by LPD Staff and
Land Preservation Committee Members, and is not an expenditure charged to
the Community Preservation Fund.

position is in FY2008 budget, but is not filled as of July 23, 2008. Duties

Land Use Consultants
This line is for contract agreements the Town has with:
· The Peconic Land Trust for Conservation Planning, Acquisition and
Professional Services.
The contracted amount for FY2008 with the Peconic Land Trust is for a
total of $60,000. $54,000 of the contracted amount is included in the
Community Preservation Fund budget for assisting the Town in
implementing the provisions of the Community Preservation Plan and
Fund. The Town budgeted $6,000 of the contracted amount in the
General Fund Whole Town Land Preservation Department budget for
instances in which PLT assists the Town with projects not part of the
Community Preservation Plan. Peconic Land Trust monthly bills are
itemized per project and reflect actual time expended.
· The Nature Conservancy for Conservation Planning, Acquisition and
Professional Services.
The contracted amount for FY2008 with The Nature Conservancy is
$20,000. TNC agreement is for work directly dedicated to implementing
the provisions of the Community Preservation Plan. TNC monthly bills are
itemized per project and reflect actual time expended.

Land Stewardship/Management
This line is for land stewardship management, site restorations and
maintenance on properties purchased with the Community Preservation Fund.
This includes:
Cornell Cooperative Extension preparing Flora & Fauna inventories for
the Town and helping the Town develop trail guides and maps;
Peconic Land Trust contract for Town for Stewardship purposes
($10,000); and
Other Contractors for assistance with clean up, maintenance, site
development, restoration and invasive species removal.
All independent contractors assist the Town in implementing the provisions of
the Community Preservation Plan. Bills are itemized per project and reflect
actual time expended. Specific properties on which work will take place and
estimated cost per property are listed in CPF Stewardship Plan Attachment A.

ATTACHMENT A
COMMUNITY PRESERVATION FUND STEWARDSHIP PLAN:
JULY 1, 2008-DEC. 31, 2008
Laurel Lake Properties
The Town of Southold has acquired 3 properties within the Laurel Lake area with
Community Preservation Funds:
SCTM# 1000-125-1-14 (NOFO/McFeely) 30.70 acres
SCTM# 1000-121-5-4.1 (Adamowicz) 10.00 acres
SCTM# 1000-125-1-6.3) (Young) 10.68 acres
These properties, together with additional properties owned by New York State, Suffolk
County, the Town of Southold and the Suffolk County Water Authority, make up the Laurel
Lake Preserve. The Town of Southold has management agreements with the State, the
County and the Suffolk County Water Authority to create a trail system within the Laurel Lake
Preserve Area. The trail will be designed, constructed and maintained by the Town of
Southold, creating a 520-acre passive recreation area which will encompass most of the land
surrounding Laurel Lake.
The Town of Southold has received a $97,500 grant from New York State Parks, Recreation
and Historic Preservation for the Laurel Lake Preserve Area. The grant will enable the Town
of Southold and its partners to:
· Link the preserved parcels around Laurel Lake through a trail system
· Improve public access to Laurel Lake
· Remove old dilapidated building and debris
· Create a handicapped accessible observation deck, overlooking Laurel Lake
· Construct and re-design parking lot at the trail head of the Laurel Lake Preserve
Work will be performed by Town Department of Public Work Employees and outside
contractors. Costs will reflect actual time expended, supplies and materials.
Estimated cost for all of the above, in addition to ongoing general maintenance of existing
trails and grassland areas, is $98,550. Funds from the Community Preservation Fund will be
used to complete the described work within the Laurel Lake Preserve. The Town will be
reimbursed from the awarded $97,500 grant. All grant re-imbursements will be deposited into
the Community Preservation Fund.
Pipes Cove Preserve
Reese/Stackler
The Town of Southold has acquired properties within the Pipes Cove Preserve Area with
Community Preservation Funds. The town of Southold proposes to remove the invasive
Community Preservation Fund Management and Stewardship Plan:

species Phragmites australis from 3.6 acres located within the properties formerly known
as the Stackler Property (SCTM# 1000-45-5-7.1, 7.2 and 1000-47-2-33, 34 and 1000-53-
1-18) and the Reese Property (SCTM# 1000-45-5-5) both within the Pipes Cove
Preserve. The Phragmites will be cut and wicked over a period of three years. A five
year monitoring program will be established to record the success of the project and
identify areas in need of follow up treatment. The goal of the project is to permanently
remove Phragmites from the affected upper tidal wetland (locales), encouraging the
recruitment of native plant species.
The Town will contract a certified pesticide applicator with proven experiences in the
eradication of Phragmites within tidal wetland systems. Successful control of Phragmites will
require a combination of mechanical and chemical control over a three year schedule. The
strategy recommended for Pipes Cove includes herbicide applications, followed by biomass
removal via cutting during the dormant season. The application technique will depend on the
size, and density of each individual Phragmites stand. Larger stands generally will be
treated using the 8TRAC, a specifically modified, amphibious all-terrain vehicle. Smaller
stands will be treated using primarily backpack spray equipment. Sensitive areas where
Phragmites exists within predominantly native vegetation will be treated by wicking of stem
and leaves. Cutting will be accomplished primarily by a Iow-ground pressure, tracked brush
hog. Sensitive areas where native vegetation is mixed will be accomplished through manual
cutting.
The project site will be monitored by a Southold Town designee assigned to the Phragmites
eradication project. The locales targeted for eradication will be photographed before and
after each phase of the project schedule. Transects will be established for purposes of
monitoring the eradication results. The Phragmites eradication project and results will further
be utilized in Stewardship applications such as invasive species education and Phragmites
australis eradication projects throughout Southold Town.
The Pipes Cove Preserve Phragmites eradication project is a grant reimbursement/town
match for $30,000.00 awarded by the New York State Department of Environmental
Conservation. Funds from the Community Preservation Fund will be used to complete the
described work within the Pipes Cove Preserve. The Town will be reimbursed from the
awarded $30,000 grant. All grant re-imbursements will be deposited into the Community
Preservation Fund.

I. Purpose - In compliance with the recently-enacted New York State legislation relating to Peconic Bay
Community Preservation Fund Administration Reforms, the Land Preservation Department has prepared a 2008
Management and Stewardship Plan for real property interests acquired through the fund. This plan must be
O adopted by local law and all expenditures from the fund for management and stewardship functions must be in
compliance with the terms of the plan.
11. Chapter 17 of the Code of the Town of Southold is hereby amended as follows:
§ 17-13A. Community Preservation Fund Management and Stewardship Plan adopted.
A. The Town Board of the Town of Southold hereby approves and adopts the Community
Preservation Management and Stewardship Plan for real property interests acquired by use
of moneys from the Town of Southold Community Preservation Fund, prepared by the Land
Preservation Department and Land Preservation Committee, for the period July 1, 2008 through
December 31, 2008, presented to the Town Board during the Work Session of August 12, 2008,
and intended to be the management and stewardship plan required by amendments to § 64-e of
the New York State Town Law.

II1. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose - In compliance with the recently-enacted New York State legislation relating to
Peconic Bay Community Preservation Fund Administration Reforms, the Land Preservation
Department has prepared a 2008 Management and Stewardship Plan for real property interests
acquired through the fund. This plan must be adopted by local law and all expenditures from the
fund for management and stewardship functions must be in compliance with the terms of the
plan.

II. Chapter 17 of the Code of the Town of Southold is hereby amended as follows:
§ 17-13A. Community Preservation Fund Management and Stewardship Plan adopted.
A. The Town Board of the Town of Southold hereby approves and adopts the
Community Preservation Management and Stewardship Plan for real property interests acquired
by use of moneys from the Town of Southold Community Preservation Fund, prepared by the
Land Preservation Department and Land Preservation Committee, for the period July 1, 2008
through December 31, 2008, presented to the Town Board during the Work Session of August
12, 2008, and intended to be the management and stewardship plan required by amendments to §
64-e of the New York State Town Law.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

recommendation that the proposed action is CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Town Board shall consider this recommendation in preparing its

I. INTRODUCTION
On July 23, 2008, Governor Paterson signed A. 10724/S.811 into law. This
legislation enacted into law administrative reforms to the Peconic Bay
Community Preservation Fund. The legislation became effective immediately as
of July 23, 2008.
One of the amendments to the law provides that each town may establish a
management and stewardship plan for lands acquired by the fund. The revised
New York State Town Law Section 64-e 6 reads as follows:
"As part of, or in addition, to said Community Preservation Fund Project
Plan, each Town Board may also adopt a Management and Stewardship
Plan of interests or rights in real property acquired pursuant to this
Section. No monies from the fund shall be expended for management and
stewardship, except as approved in said Plan. Said Plan may provide
management and stewardship projects for up to a three year period and
shall provide a description and estimated cost for each project. Said Plan
shall be approved and adopted by Local Law and may be updated from
time to time at the discretion of the Town Board. Only management and
stewardship projects permitted pursuant to Subdivision Nine-A of this
section shall be eligible to be included in the Plan."
This Community Preservation Fund Management and Stewardship Plan (CPF
Stewardship Plan) identifies how Southold Town will expend monies from the
Community Preservation Fund for management and stewardship for the period
of July 1, 2008 - December 31, 2008.
On November 20, 2007, the Town Board adopted the Town Budget for FY2008.
The Town Budget includes an Expenditure Budget for the Community
Preservation Fund. Since the revised CPF legislation was adopted after the
Town Board adopted the FY2008 Town Budget, the CPF Stewardship Plan is
retroactive to the existing Expenditure Budget for the Community Preservation
Fund from the Town Board approved FY2008 budget.

III. ADDITIONAL DETAILS FOR SPECIFIC LINE ITEMS
Additional details for specific line items are described below and within CPF
Stewardship Plan Attachment A. CPF Stewardship Plan Attachment A lists all
open space properties acquired with Community Preservation Funds and notes
projects and cost estimates for FY2008 for each property. The list does not
include agricultural easements acquired with Community Preservation Funds.
When the Town purchases agricultural easements, the landowner remains the
steward of the land. The Town performs yearly monitoring of agricultural
easements. During FY2008 monitoring is to be performed by LPD Staff and
Land Preservation Committee Members, and is not an expenditure charged to
the Community Preservation Fund.
Site Development Personal Services, Full Time Employees, Reg Earnings
This line is for Stewardship work performed by Department of Public Works
(DPW) Staff on properties purchased with Community Preservation Funds.
Work includes: trail mowing and maintenance, invasive species removal,
grassland restoration and maintenance, debris removal and similar types of
activities.

This line is for contract agreements the Town has with:
· The Peconic Land Trust for Conservation Planning, Acquisition and
Professional Services.
The contracted amount for FY2008 with the Peconic Land Trust is for a
total of $60,000. $54,000 of the contracted amount is included in the
Community Preservation Fund budget for assisting the Town in
implementing the provisions of the Community Preservation Plan and
Fund. The Town budgeted $6,000 of the contracted amount in the
General Fund Whole Town Land Preservation Department budget for
instances in which PLT assists the Town with projects not part of the
Community Preservation Plan. Peconic Land Trust monthly bills are
itemized per project and reflect actual time expended.
· The Nature Conservancy for Conservation Planning, Acquisition and
Professional Services.
The contracted amount for FY2008 with The Nature Conservancy is
$20,000. TNC agreement is for work directly dedicated to implementing
the provisions of the Community Preservation Plan. TNC monthly bills are
itemized per project and reflect actual time expended.

Land Stewardship/Management
This line is for land stewardship management, site restorations and
maintenance on properties purchased with the Community Preservation Fund.
This includes:
Cornell Cooperative Extension preparing Flora & Fauna inventories for
the Town and helping the Town develop trail guides and maps;
Peconic Land Trust contract for Town for Stewardship purposes
($10,000); and
Other Contractors for assistance with clean up, maintenance, site
development, restoration and invasive species removal.
All independent contractors assist the Town in implementing the provisions of
the Community Preservation Plan. Bills are itemized per project and reflect
actual time expended. Specific properties on which work will take place and
estimated cost per property are listed in CPF Stewardship Plan Attachment A.

COMMUNITY PRESERVATION FUND STEWARDSHIP PLAN:

Laurel Lake Properties
The Town of Southold has acquired 3 properties within the Laurel Lake area with
Community Preservation Funds:
SCTM# 1000~125-1-14 (NOFO/McFeely) 30.70 acres
SCTM# 1000-121-5-4.1 (Adamowicz) 10.00 acres
SCTM# 1000-125-1-6.3) (Young) 10.68 acres
These properties, together with additional properties owned by New York State, Suffolk
County, the Town of Southold and the Suffolk County Water Authority, make up the Laurel
Lake Preserve. The Town of Southold has management agreements with the State, the
County and the Suffolk County Water Authority to create a trail system within the Laurel Lake
Preserve Area. The trail will be designed, constructed and maintained by the Town of
Southold, creating a 520-acre passive recreation area which will encompass most of the land
surrounding Laurel Lake.
The Town of Southold has received a $97,500 grant from New York State Parks, Recreation
and Historic Preservation for the Laurel Lake Preserve Area. The grant will enable the Town
of Southold and its partners to:
· Link the preserved parcels around Laurel Lake through a trail system
· Improve public access to Laurel Lake
· Remove old dilapidated building and debris
· Create a handicapped accessible observation deck, overlooking Laurel Lake
· Construct and re-design parking lot at the trail head of the Laurel Lake Preserve
Work will be performed by Town Department of Public Work Employees and outside
contractors. Costs will reflect actual time expended, supplies and materials.
Estimated cost for all of the above, in addition to ongoing general maintenance of existing
trails and grassland areas, is $98,550. Funds from the Community Preservation Fund will be
used to complete the described work within the Laurel Lake Preserve. The Town will be
reimbursed from the awarded $97,500 grant. All grant re-imbursements will be deposited into
the Community Preservation Fund.
Pipes Cove Preserve
Reese/Stackler
The Town of Southold has acquired properties within the Pipes Cove Preserve Area with
Community Preservation Funds. The town of Southold proposes to remove the invasive

species Phra~lmites australis from 3.6 acres located within the properties formerly known
as the Stackler Property (SCTM# 1000-45-5-7.1, 7.2 and 1000-47-2-33, 34 and 1000-53-
1-18) and the Reese Property (SCTM# 1000-45-5-5) both within the Pipes Cove
Preserve. The Phragmites will be cut and wicked over a period of three years. A five
year monitoring program will be established to record the success of the project and
identify areas in need of follow up treatment. The goal of the project is to permanently
remove Phragmites from the affected upper tidal wetland (locales), encouraging the
recruitment of native plant species.
The Town will contract a certified pesticide applicator with proven experiences in the
eradication of Phragmites within tidal wetland systems. Successful control of Phragmites will
require a combination of mechanical and chemical control over a three year schedule. The
strategy recommended for Pipes Cove includes herbicide applications, followed by biomass
removal via cutting during the dormant season. The application technique will depend on the
size, and density of each individual Phragmites stand. Larger stands generally will be
treated using the 8TRAC, a specifically modified, amphibious all-terrain vehicle. Smaller
stands will be treated using primarily backpack spray equipment. Sensitive areas where
Phragmites exists within predominantly native vegetation will be treated by wicking of stem
and leaves. Cutting will be accomplished primarily by a Iow-ground pressure, tracked brush
hog. Sensitive areas where native vegetation is mixed will be accomplished through manual
cutting.
The project site will be monitored by a Southold Town designee assigned to the Phragmites
eradication project. The locales targeted for eradication will be photographed before and
after each phase of the project schedule. Transects will be established for purposes of
monitoring the eradication results. The Phragmites eradication project and results will further
be utilized in Stewardship applications such as invasive species education and Phra~lmites
australis eradication projects throughout Southold Town.
The Pipes Cove Preserve Phragmites eradication project is a grant reimbursement/town
match for $30,000.00 awarded by the New York State Department of Environmental
Conservation. Funds from the Community Preservation Fund will be used to complete the
described work within the Pipes Cove Preserve. The Town will be reimbursed from the
awarded $30,000 grant. All grant re-imbursements will be deposited into the Community
Preservation Fund.
