THIS INDENTURE, made the Nth day of January, 2005, between
Edward Dart and July L. Dart, residing at No~ Peconic Lane, Peconic NY 11958,
party of the first part, and
Paul's Plac,~ LLC, a New York Limited Liability Company, with offices at 2935
Peconic Lane, Peconic NY 11958, party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars and
other good and valuable consideration paid by the party of the second part, do~s hereby grant
and release unto the party of thc second part, the heirs or successors and assigns of the party
of the second par forever,
ALL that certain plot, piece off parcel of land with the building and improvements
thereon erected, situate, lying and being at Pancnic, in the Townof Southold, County of
Suffolk, and State of New York, more particularly bounded and described as follows:
BEGINNING at a point on the westerly line of Peconic Lane 77.81 feet northerly
along said westerly line from land of Lane Island Rat]rued Co., said point of Beginning being
the northeasterly corner of land now or formerly of Blaschack: from said point of Beginning:
RUNNING thence along said land of Blaschack, south 55 degrees 5 minules 20
seconds west 130 feet:
THENCE along said land of Bleschack and land now or formerly of Adipietro, south
34 degrees 41 minutes $0 seconds east 51.8 feet to said'land of Long Island Railroad Co.;
THENCE along said land of Long Island Railroad Co., south 55 degrees 5 minutes 20
seconds west 95 feet;
THENCE along land of thc party of thc first pan. two courses as follows:
I) North 34 degrees 41 minutes .50 seconds west 135.79 feet: and
2) North 55 degrees 18 minutes 10 seconds east 2..5 feet to thc westerly line of
Peconic Lane;
THENCE along said westerly line, south 34 degraes 41 minutes 50 seconds east 83.15
feet t6 the point or place of BEGINNING.
BEING AND IN't'~NDED to be the same premises conveyed to the parties of the first
pan by deed dated :5/11/87 and recorded in the Office of the Suffolk County Clerk on 5/26/87

TOOETHER with all right, title and interest, if any, of thc party of the first part in and
to any streets and roads abutting thc above .d~r, eribed promises to the center lines thereof,
TOGETHER with the appurtenances an.d all the estate and right~ of the party of the
first part in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of thc second
pan, the I~eirs or successors and assigns of the party of the second pan forever.
AND the party of the first part, covenants that the party of the first part has not done or
suffered anything whereby the said premises haye been encumbered in any way whatever,
except as afon~said.
AND the party of the first pail, in compliance with Section 13 of thc Lien Law,
covenants that the party of the first pan will receive the consideration for this conveyance and
will hold thc right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to thc payment of
the cost of the improvement before using any part of the total of the same for any other
