Gardner, husband and wife, both residing at 191 Carroll Street / Port Jefferson Station, New York 11776 party of the second part, ~-Iooo -o~q.oo -o~.oo · Oq~.oO0 WITNESSETH, that the party of the first part, in consideration of Ten Dollars ($10.00), lawful money of the United States, paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or pamel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York known as and by Lot 23, as shown and laid out on a certain map entitled, "Subdivision Map of Bayview Woods Estates at Bayview, Town of Southold, Suffolk County, New York, December 23, 1969", Van Tuyl & Son, Lic. Land Surveyor, and filed in the Suffolk County Clerk's Office on September 9, 1970 as Map No. 5520, said lot being more particularly bounded and described as follows: BEGINNING at a point on the easterly side of North Bayview Road at the division line between Lots 23 and 22 on above mentioned map; RUNNING THENCE South 87 degrees 20 minutes 40 seconds East along above mentioned division line, 139.95 feet to a point and land now or formerly of Reese; THENCE the following 2 courses and distances along last mentioned land: 1) South 27 degrees 19 minutes 20 seconds West, 54.12 feet to a point; 2) South 26 degrees 55 minutes 00 seconds West, 285.63 feet to the easterly side of North Bayview Road; THENCE North 2 degrees 39 minutes 20 seconds East along the easterly side of North Bayview Road, 309.57 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated 8/15/92 and recorded on 8/26/92 in Liber 11526, Page 410. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the ab6ve described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises, TO HA VEAND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, covenants that tl~e party of the first part has not suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. ~..~ . AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
