party of the first part, and JAMES P. MULHALL and KRISTIN A. MULHALL, his wife, both
residing at 1725 Alvah's Lane, Cutchogue, NY 11935
party of the second part,
WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Mattituck in the Town of Southold, County of Suffolk and State
DISTRICT: of New York, known and designated as Lot 21 on Map of Elijah's Lane Estates, Sectic
1000 2, filed in the Suffolk County Clerk's Office on October 8, 1996, as Map No. 9912,
bounded and described as follows:
SECTION: BEGINNING at a point on the Easterly side of Gabriella Court, distant 765.03 feet
108.00 southerly from the most southerly end of a curve which connects the easterly side
BLOCK: of Gabriella Court with the southerly side of Tabor Road;
04.00 RUNNING THENCE north 52 degrees 79 minutes 20 seconds east, along the division line
of lots 21 and 22 on aforesaid map, 263.85 feet;
LOT:
007.026 THENCE south 38 degrees 14 minutes 50 seconds east, 151.26 feet along the
subdivision line of "Elijah's Lane Estates, section 1;
THENCE south 52 degrees 79 minutes 20 seconds west, 265.35 feet to the easterly
side of Gabriella Court;
THENCE north 37 degrees 40 minutes 40 seconds west, 151.25 feet along the easterly
side of Gabriella Court to the point or place of BEGINNING.
This transaction is made in the ordinary course of business of the grantor with
unanimous consent frctn all of the shareholders.
The premises are not in an agricultural district and the premises are entirely
awned by the transferor.
The grantor herein is the same as.the qrantee in deed dated January 29, 1997 and
recorded in the Office of the Clerk of the County of Suffolk on March 10, 1997
in Liber 11819 Page 801.
TOGE:TIIIR with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party” shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
