EXECUTOR'S DEED
THIS INDENTURE, made the 22nd day of December, 1997, between KENNETH P.
SILVERMAN, as Executor of the Estate of Henrietta Silverman under the last will and testament
of Henrietta Silverman, late of Nassau County,deceased, having an address c/o Jaspan Schlesinger
Silverman&Hoffman, LLP, 300 Garden City Plaza, Garden City, New York 11530,party of the
first part, and BARRY MALLIN and GAIL KRIEGEL MALLIN,having an address of 93 Mercer
Street,New York, New York 10012,party of the second part,
WITNESSETH,that the party of the first part,by virtue of the power and authority given
in and by said last will and testament, and in consideration of Four Hundred Forty Thousand and
00/100 ($440,000.00) dollars, paid by the party of the second part, does hereby grant and release
unto the party of the second part,the heirs or successors and assigns of the party of the second part,
forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon
erected, situate,lying and being in the Town of Southold, County of Suffolk and State of New York,
as further described in Schedule "A" annexed hereto and made a part hereof.
TOGETHER with all right,title and interest, if any, of the party of the first part of, in and
to any streets and roads abutting the above-described premises to the center lines thereof;
TOGETHER with the appurtenances, and also all the estate which the said decedent had at
the time of decedent's death in said premises,and also the estate therein,which the party of the first
part has or has power to convey or dispose of, whether individually, or by virtue of said will or
otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,
the heirs or succelssors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been incumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the improvement
before using any party of the total of the same for any other purpose.
The word "party" shall be construed as if it reads "parties" whenever the sense of this
indenture so requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Nassau Point, Town of Southold, County of Suffolk and State
Of New York, known and designated as part of lot 222 as shown on a certain map entitled,
"Amended Map of Nassau Point", filed in the Suffolk County Clerk's O6ce on 8/16/22 under
Map #156 and a portion of Bayberry Road; said part of lot and part of Bayberry Road being
bounded and described as follows;
BEGINNING at a point on the Northerly side of Wunneweta Road at the extreme Easterly end of
an arc of curve connecting the Northerly side of Wunneweta Road and the Easterly side of
Bayberry Road;
RUNNING THENCE Westerly along the Northerly side of Wunneweta Road along the arc of an
irregular curve bearing to the right the chord of which runs along a bearing of North 72 degrees
26 minutes West 269.21 feet to a point in another chnrd;
THENCE Northerly along the Northerly and Easterly side of Wunneweta Road along the arc of
an irregular curve bearing to the right the chord of which runs along a bearing of North 46
degrees 00 minutes West 167.66 feet to a point in another chord;
THENCE Northerly along the Easterly side of Wunneweta Road along the arc of an irregular
curve bearing to the right to the Southerly line of Parcel A herein described;
THENCE North 49 degrees 00 minutes East along the last mentioned division line 350 feet to a
point on the Northerly side of Bayberry Road which is distant 14.0 feet Northwesterly as
measured along the Northerly side of Bayberry Road from the point where the division line
between lots 137 and 138 on the above mentioned map intersects the Northerly side of Bayberry
Road;
THENCE Southerly along the Northerly side of Bayberry Road along the arc of an irregular curve
bearing to the right, 14.0 feet to a point in another chord and the point where the division line
between lots 137 and 138 intersects the Northerly side of Bayberry Road;
THENCE Southeasterly and Southerly of the Northerly and Easterly side of Bayberry Road
along the arc of an irregular curve bearing to the right the chord of which runs along a bearing of
South 42 degrees 23 minutes East, 116.54 feet to a point in another chord;

West 102.80 feet to a point in another chord and the point of intersection between the division
line between lots 133 and 134 on the above mentioned map and the Easterly side of Bayberry
Road;
THENCE Southerly still along the Easterly side of Bayberry Road along the arc of an irregular
curve bearing to the left the chord of which runs along a bearing of South 9 degrees 06 minutes
East 99.90 feet to a point in another chord;
THENCE Southeasterly along the Easterly side of Bayberry Road along the arc of an irregular
curve bearing of South 61 degrees 55 minutes East 43.64 feet to the Northerly side of
Wunneweta Road, the point or place of BEGINNING.
