The owner of this site was issued appearance tickets in the summer of 1996 for
long term outdoor storage without a site plan and for use without a C.O. ( an
addition to the existing building). In late 1997 the case went to trial and the
charges were dismissed by the Judge.
I response to this case, however, the owner applied for a C.O. for the addition
that was built pursuant to the permits and the approved Site Plan dated 1987.
Several attempts to issue the C.O. were not recommended by Planning due to
the non-compliance with the 1987 plan. In March 2001 the C.O. was finally
issued based on a memo from Planning that the conditions of the approved plan
dated 1987 had been met (copy attached).
In October 2005, the owner was once again issued appearance tickets for a
change in intensity without Site Plan approval. That case resulted in the
application for an amendment that has yet to be finalized by the applicant.
On Sept 30, 2008 three more appearance tickets were issued for failure to obtain
approvals for the expansion and change in intensity of the site. This case is
pending in Justice Court at this time.

On this day an inspection was made of the above project to determine ifa C.O. should be
issued.
All conditions of the September 14, 1987, approved plan have been met, including the
removal of the cabs from the front parking area.

Re: Bill Penney's "TIDY CAR" corner.
Several months ago, Bill Penney assured me that he had sufficient acreage in the
rear of his place of business to re-locate the multitude of trailers, atvehicles, and
other assorted eyesores, on the corner of Young's Avenue and Route 48, (the North
road. Lately, it has become several times worse, and I do believe that someone
should find a way to persuade Bill Penney to do what he said he is going to do. The

Dear Bruno & Amy:
Pursuant to our meeting on September 12, 2006 at 9:30 am in reference to Tidy Car site
plan with Bruno Simone, Amy Ford from the Southold Planning Department and Damon
Rallis from the Southold Building Department, listed below are the planning boards
recommended changes and comments.
Southold Planning Departments recommendations regarding County matters:
· Move curb cut - County would appreciate it to be moved further away from
traffic light.
· Will be a right turn only
· If County sees gravel entrance off of town road, will probably deny curb cut on
County Road.
· Move gravel driveway. Town would not like to see from road and County will
deny curb cut.
Southold Town Recommendations and Comments:
· Show circulation of use
· Show stock storage
· Show radius of campers & trailers
· Check Buffer code
· Check height of display limit
· Check Zoning to adjoining parcel on Youngs
· Future cross over to adjoining parcel

Damon Rallis said it will take approximately 2 weeks to receive the written
response.
McCarthy Management, Inc. has been hired by Mr. William Penney, III to move forward
with his amended site plan and to see all municipal approvals to completion.
At this time, Damon Rallis has requested that McCarthy Management, Inc. submit a clean
copy of the site plan to him along with a building permit application. We are in the
process of completing the necessary paper work for submittal to the building department.
It is our understanding that Mr. William Penney, III has received a notice of violation on
his property located at 3585 Youngs Avenue, Southold, NY 11971 and is summoned to a
court hearing Friday, September 15, 2006.
We are requesting written acknowledgement of our meeting to present to the courts on
Friday to show that McCarthy Management, Inc. is presently enduring to comply with the
most recent site plan.

violation of Southotd Town Code section 100-250, for operating without an
approved site plan. He is scheduled for appearance in Town Justice Court on OCt
21,2005 for arraignment on that charge.

At the work session on 9/26/05, the Planning Board decided to refer this long
expired site plan to your office for appropriate Code Enforcement action. The
applicant (W. Penny), was not responsive to Chairperson Woodhouses' letter of
9/8/05, and failed to submit the requested information asked for in that letter. The
only correspondence received from the applicant (9/20/05) was a letter
requesting a further extension, which the Planning Board denied. He also
submitted a hand drawn revised site plan drawing ,which met none of the
standards for submission. He asked for its return and stated he was hiring
professional representation to develop a new site plan for our review. Please
follow up on enforcement and advise me or Bruno on the progress of activities.

We plan to downsize our entire operation to a degree due to escalating costs and a loss of
a key employee.
We ask for your cooperation in these strange economic times as we decide which
direction is the best way for our business to go in.
We are working on retaining representation to expedite this matter as we realize that
time is of the essence and we don't have much of it to get things done without help.

The Planning Board held a work session on August 9, 2005 to review the site plan application
status and this letter is notification of the following issues:
Please note that the above-referenced site conditions are not in compliance with the site plan approved
on September 14, 1987.
Further note that the Site Plan Approval expired on September 14, 2000 as per Town Code Section 100-
255 Section A which states: "An approved site development plan shall be valid for a period of three
years from the date of approval. All work proposed on the plan shall be completed within three years
from the date of approval unless a longer period was approved or the applicant obtains an extension
from the Planning Board." Therefore, the time frame to complete the work has expired.
The Planning Department is unable to process the application for the amended site plan submitted July 28,
2000 without additional site plan materials which have been previously requested. Your immediate
attention is required for submission of the missing site plan materials to the Planning Department.
Attached are a site plan application and checklist for your review. The following is the minimum required
submission: revised site plan-detailing the smaller building, environmental assessment form, building
plans and a new revised site plan application. If this information is not received by September 20, 2005
the Planning Board will close the file on the amended site plan application as incomplete and inactive, and
the matter will be referred to the Code Enforcement Officer and Town Attorney for prosecution.

RESOLVED that the Southold Town Planning Board approve the
site plan'for Tidy Car for construction located at County Road
48 and Youngs Avenue, Southold, site plan dated as amended
September 11, 1987.
It was noted that this plan has been certified by the
Building Department.
The conditions are as follows:
Handicapped parking shall be clearly marked on site
with signs and blue striping as per New York State law.
The curb cut on County Road 48 shall be marked so as
to prevent vehicular access to County Road 48 from the
site.
Subject to any changes in the drainage that my be
requested by the Town Engineer.
Subject to the planting of ~treet trees as per
Highway Specifications to be locat=d between 18 and
]5' inside the existing curb line.

This letter is in regard to East End Car Care inc., located at 3585 young's ave. & rte. 48 Southold town
As per my conversation with Bruno on Monday January 3, 2005, we would like to inform you that we are
actively working on our site plan regarding inventory storage and new building construction.
Due to ever rising construction costs, we have decided to downsize the new buildin8 to 60 x 80 from the
original 80 x 100 that was previously approved by the Town ZBA.
We feel this size building (60 x 80) will still warehouse a large portion of our inventory.
With proper landscaping and inventory arrangement, this will benefit our growing business and also eye
appeal for Southold Town.
We will be in further contact with Bruno in order to be able to attend your next meeting to discuss this
matter further.

Dear Mr. Orlowski:
This letter is in reference to the proposed site plans for changes to the "Tidy Car/East End Campers"
property: Lot # 55-5-2.2.
We have spoken with Mr. Forrester on several occasions in the past about our concerns over the appearance
of the grounds surrounding the "Tidy Car/East End Campers" site: especially the ever-growing number of
trailers, campers and cars parked all over the site and, particularly, along the side of the road facing our
house, making it look worse than a used car lot. He told us he would look into it and see what could be done.
Upon a recent visit to Southoid Town Hall, we talked with Mr. Forrester who helpfully explained that they
had taken certain steps but there was nothing further the Code Enforcement Office could do to change the
situation. He told us that Mr. William Penney (the owner of the property) had proposed a site change to
provide for housing the RVs, etc. in a separate building and these plans were in the pending approval stage.
We informed him that we had received notification of these plans quite some time ago, believed they had
been approved and wondered when Mr. Penney would be proceeding with the implementation of his plan.
Mr. Forrester took us over to the Planning Board Office where we met Mr. Bruno Semon, Mr. Semon was
extremely pleasant and cooperative and brought out the fde. He noted that there was no documentation in
the file that anyone had raised objections over the existing appearance of the area and recommended we
write to you so that ours would be included in the record. He also showed us a blueprint of the plans and said
the board was awaiting follow-up by Mr. Penney on additional requested clarifications. Both Mr. Seman and
Mr. Forrester indicated they would speak to Mr. Penney about this matter and suggested we do the same.
We did speak with Mr. Penney who was gracious and stated he was anxious to move ahead with the plans,
hoped it would be done by September, would move the vehicles into the new building, assured us that the
gate entrance on the driveway leading to the new building would be recessed so far that we would not see it
from our front porch; that there would be foliage planted along side to obscure the fence, and that the
grounds would be landscaped. We hope this is so and, because we're not very good at reading blueprints,
hope you will make sure it is included in the plans the board approves.
In closing, we want to state that we are pleased for Mr. Penney that his business is flourishing, he is a
pleasant and hardworking man; we feel businesses are the life-blood of the North Fork; we need them and

Reasons Supporting This Determination:
This project involves the construction of a 8,645 square foot addition to an
existing retail building. A retail store is a permitted use in this General Business
Zone, thus the proposed action is consistent with zoning.
The applicant has secured a width variance from the Board of Appeals.
An Environmental Assessment Form has been submitted and reviewed, and it
was determined that no significant adverse effects to the environment were likely
to occur should the project be implemented as planned.
There has not been any correspondence received from the Department of Health
Service in the allotted time. Therefore, it is assumed that there are no comments
or objections from that agency.
There has not been any correspondence received from the New York State
Department of Environmental Conservation in the allotted time. Therefore, it is
assumed that there are no comments or objections from that agency.
The applicant will have to comply with the requirements of the Suffolk County
Sanitary Code (SCSC) and all relevant standards of water supply and sewage
disposal systems. Design and flow specification, subsurface soil conditions and
site plan details will have to be approved by the Suffolk County Department of
Health Services (SCDHS). This impact is not considered significant due to the
anticipated project compliance with established requirements of the SCSC and
the SCDHS and the required relevant permits.

An inspection was made of the previously approved site plan and a recommendation was
sent to the Building Department to issue a Certificate of Occupancy. All truck cabs have
been removed from the front parking area.
The Board has reviewed your revised site plan dated January 3, 2001, regarding the
above project. The following changes/additions must be made to the plan before we can
proceed with its review:
A condition of the variance granted to you by the Zoning Board was a
landscaping plan for the area between the front of the new building and
County Route 48. The Board recommends that a visual barrier be created by
planting white pines 14' tall, 15' on center, across the front of the proposed
storage building. This row of pines should be planted 25' south of the north
property line. A five foot landscaped area planted with Iow evergreens should
be planted in front of the proposed building.
A 25 foot wide transitional landscaped buffer must be planted on the south
side of the property next to the residential area. This buffer should consist of a
staggered double row of evergreens six feet tall planted ten feet on center.
Elevation drawings must show connection to existing building, materials and
color.
4. Show zone lines on the plan.
5. Show any proposed outdoor lighting. All lighting must be shielded to the
property. Please provide cuts of the fixtures and indicate wattage.
6. Show type of surface behind (south) of the proposed storage building and
south of the existing building.
7. Show all existing trees greater than six inches in diameter.
Street trees should be planted along County Route 48 and Youngs Avenue.
These trees should be planted forty feet on center. Red maples or pin oaks are
a recommended species. The trees should be planted so as not to be under
overhead wires.
In addition to the above, a review will be required by the Suffolk Department of health
Services, and the Suffolk County Water Authority.

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: Applicant's property consists of a total area of 1.4963
acres located on the comer of Youngs Avenue and the south side of County Road 48 in
Southold. The updated January 3, 2001 site map shows an existing one-story building (Tidy
Car), detached frame building, parking areas, and the owners' proposed 80x100 ft. storage
building. The property is zoned B General Business.
BASIS OF APPEAL: Building Inspector's November 27, 2000 Notice of Disapproval
concerning an application for a building permit to construct a proposed storage building.
The reasons stated in the Notice disapproving the project reads that a "project shall be
divided into separate structures so that no single structure shall have more than sixty (60)
linear feet of frontage on one (1) street" ref. Zoning Code Chapter 100, Article X, Section
100-103C.
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: Proposed 80x100 ft. storage area
with a 24.2 ft. fully enclosed addition attached at the southwest end of the main building.
The setbacks for the proposed storage areas are shown 50 feet from C.R. 48, 25 ff. setback
from the west property line, and 55+- from the southerly property line, at its closest points.
The addition gives the appearance of two separate buildings, with 80 ft. in width facing C.R.
48 and 30.1 ft. facing C.R. 48. The existing width is 78+- feet facing east towards Youngs
Avenue.
ADDITIONAL INFORMATION AND EVIDENCE CONSIDERED BY THE BOARD:
1. Applicant wishes to construct an 80 ft. wide by 100 ft. deep storage building to house
and display new inventory, including campers and truck cabs, which are currently stored
outside.
2. Applicant has testified that the additional 20-ft. width in the structure is required to
handle and maneuver large vehicles involved in the sale and rental of said business.
Applicant further testified that the new structure would eliminate the need for outside
storage of these vehicles and help improve the appearance of the property.

3. This is a single occupancy business use with all operations under one roof (rather than
as a strip mall with multiple uses, which is not permitted under Code Section 100-103C,
added by Local Law on 8-22-1995).
REASONS FOR BOARD ACTION:
1. The granting of the area variance will not produce an undesirable change in character of
neighborhood or a detriment to nearby properties. The new storage building should
improve the appearance of the applicant's property by providing an indoor place to display
and store truck cabs and campers, which are currently stored outside. The additional 20-ft.
width of the structure, which is the subject of this variance, will be offset in appearance by
appropriate screening set forth, and subject to this approval.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance because the Town Code limits the width of
structures to 60 feet, and the large size of the applicant's inventory require a width of 80 feet
for storage, display and maneuvering.
3. The variance is substantial and represents a 30 percent increase over the code required
60-foot width limit.
4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district. No evidence has been presented
to suggest that the variance granted herein would have a negative impact on physical or
environmental conditions in the area.
RESOLUTION: On motion by Member Tortora, seconded by Member Collins, it was
RESOLVED, to GRANT the variance as applied for, SUBJECT to the following
CONDITIONS:
This approval is subject to site plan approval by the Town Planning Board and
further subject to approval by the Town Planning Board of a landscaping plan for the
area between the front of the new building and County Route 48 to minimize the
visual impact of the new storage building.
2. There shall be no outdoor storage of vehicles for display, storage or sale in the area
between the front of the new building and County Route 48.
In considering this application, the Board deems this action to be the minimum necessary
and adequate for the applicants to enjoy the benefit of indoor storage of oversized vehicles,
and that the grant of this variance will preserve the character of the neighborhood, and
