WITNESSETH, that the party of the first part, in consideration
of less than One Hundred Dollars, as a gift between parent and
child, and other valuable consideration paid by the party of the
second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of
the second part forever,
ALL those certain lots, pieces or parcels of land, situate,
lying and being in the Town of Southold, County of Suffolk and
State of New York, and being known as lots F and a blank lot, on a
certain map entitled "Map of Indian Neck Park, George W. Smith,
owner, made by Franklin F. Overton, M.E. and surveyor, 1912", and
filed in the office of the Clerk of Suffolk County on the 27th day
of May, 1913, as and by Map No. 551, and being more particularly
bounded and described as follows:- On the north by land formerly
belonging to George W. Smith and known as lot No. 35, and by a
private way; on the East by a private way and Little Peconic Bay,
and on the South by Little Peconic Bay and by land formerly of the
Davids Estate and on the West by land formerly of the Davids
Estate.
Being the same premises heretofore conveyed to Clifton O.
Taylor and Mabel G. Taylor, his wife, by deed dated July 2, 1918,
by George W. Smith and wife, and recorded in the office of the
Clerk of Suffolk County, July 3, 1918 in Liber 968 of Deeds page
545, also, being and intended to be the same premises conveyed by
Mabel G. Taylor, widow of Clifton Taylor, to Henry E.R. Stacy, by
deed dated June 15th, 1922, and recorded in the Suffolk County
Clerk's Office in liber 1046 of deeds at page 340 on June 17, 1922
at 11 A.M.
Being the same premises conveyed to Agneta H. Ewer, by deed
dated September 25, 1942, by Henry E.R. Stacy and Grace H. Stacy,
his wife, and recorded in the office of the Clerk of Suffolk County
in liber 2255 of deeds at page 283 on October 5, 1942 at 11:41 A.M.
TOGETHER with all the right, title and interest of the parties
of the first part in and to a private right of way, and all beach
rights more fully described in a certain deed to Clifton O. Taylor
and Mabel G. Taylor, his wife, by George W. Smith and wife, dated
July 19, 1918, and recorded in the office of the Clerk of Suffolk
County on the 22nd day of July, 1918, in Liber 966 of deeds page
377.
SUBJECT to the rights of the public, if any, and others in and
to the beach, or the private road, as described in said deeds.
SUBJECT to the covenants and restrictions, if any, contained
in former deeds of record.
TOGETHER with the appurtenances and all the estate and rights
of the party of the first part in and to said premises,
To Have And To Hold the premises herein granted unto the party
of the second part, the heirs or successors and assigns of the
party of the second part forever.
AND said party of the first part covenants as follows:
FIRST. that said party of the first party is seized of said
premises in fee simple, and has good right to convey the same;
SECOND. That the party of the second part shall quietly enjoy
the said premises;
THIRD. That the said premises are free from incumbrances;
FOURTH. That the party of the first part will execute or
procure any further necessary assurance of the title to said
premises;
FIFTH. That said party of the first part will forever WARRANT
the title to said premises;
SIXTH. That the grantor receives the consideration for this
conveyance as a trust fund to be applied first for the purpose of
paying the cost of any improvement, that has been commenced upon
the premises and has not been completed at least four months before
the making and recording of this deed, and the grantor will apply
the same first to the payment of the cost of improvement before
using any part of the total of the same for any other purposes.
IN WITNESS WHEREOF, the party of the first part has duly
executed this Deed the day and year first above written.
