THIS INDENTURE,made the 19th day of December, 1997,between 158th Street Realty,
having an address at c/o Jaspan Schlesinger Silverman&Hoffman,300 Garden City Plaza,Garden
City,New York 11530("Grantor")and Barry Mallin and Gail Kriegel Mallin,having an address at 93
Mercer Street,New York,New York,("Grantee").
WITNESSETH:
That the Grantor,in consideration of Ten(510.00)Dollars paid by the Grantee,docs hereby
grant and release unto the Grantee,the heirs or successors and assigns of the Grantee forever,all of the
Grantor's right,title and interest in and to:
ALL that certain plot,piece or parcel of land with the buildings and improvements thereon
erected,situate.Iving and being in the Town of Southold.County of Suffolk and State of New York,
bounded and described in Schedule"A"annexed hereto and made a part hereof.
TOGETHER with all right,title and interest,if any.of the Grantor in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the Grantor in and to said
premises.
TO HAVE AND TO HOLD,the premises herein granted unto the Grantee,the heirs or
successors and assigns of the Grantee forever.
AND the Grantor covenants that the Grantor has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
AND the Grantor,in compliance with Section 13 of the Lien Law covenants that the Grantor
will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund for the purpose of paying the cost of the improvement and will apply the same first to
the payment to the cost of the improvement before using any part of the total of the same for any other
purpose.
The words"Grantor"and"Grantee"shall be construed as if they read"Grantors"and
"Grantees"whenever the sense of this indenture so requires.
Being and intended to be the same premises conveyed to the Grantor herein by deed dated April
22, 1983,recorded April 27, 1983 in Liber 9749,Page 110.
IN WITNESS WHEREOF,the Grantor has duly executed this deed the day and year first above

ALL that certain plot, piece or parcel of land, with the buildings and 'improvements thereon
erected,situate,lying and being at Nassau Point,Town of Southold,County of Suffolk and State
of New York known and designated as part of lot 222 as shown on a certain map entitled,
'Amended Map of Nassau Point', filed in the Suffolk County Clerk's Office on 8/16/22 under
Map 9156 and a portion of Bayberry Road; said part of lot and part of Bay" Road being
hounded and described as follows:
BEGINNING at a monument on the Northerly side of Bayberry Road where the same is
intersected by the division line between lots 139 and 140 on the above mentioned map:said point
of beginning also being on the Easterly side of Wunneweta Road where same is intersected by the

THENCE Northerly along the Easterly side of Wunneweta Road along the arc of a curve bearing
to the right to a point which is the following two courses and distances from the point of
beginning.
