WITNESSETH, that the party of the f~t part, in consideration ofTen Dollars and other valuable consideration
paid by thc party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being in the

SUBJEC~ TO a life estate reserved to the parties of the first part/
or the survivor of them.
UPON the death of the life tenants, in the event the remaindermen
wish to sell the real property, which is.the subject of this deed,
then and in that event DAVID J. OT.IVEIRA and SUSAN AMIAGA OLIVEIRA
shall have a right of first refusal to purchase which*is more
particularly set forth in an Agreement made this 1 st day of November
2004.
BEING AND ~ED TO BE the same premises conveyed to the parties
of the first part by deed dated 02/10/72 and recorded in the Office
of the Clerk of the County of Suffolk on 02/18/72 in Liber 7109
Page 174, and by deed dated 01/06/77 and recorded in the Office of
the Clerk of the County of Suffolk on 01/1 3/77 in Liber 8173 Page 555.
TOGETHER with all right, title and interest, if any, of the party of the fwst part of, in and to any strcets and
roads abutting the above-described premise~ to the center lines the..r.cof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
thc premises herein granted unto the party of the second part, thc heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of thc first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that thc party of thc
first part will receive the consideration for this conveyance and will hold the fight to receive such consideration
as a. trust fund to be applied first for the purpose of paying the cost of thc improvement and will apply the same
first to the payment of thc cost of the improvement before using any part of the total of thc same for any other
purpose.
The word "party" shall be construed a~ if it read "parties" whenever the sense of this indenture so requires.
