Clerk's Office.
TOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads
abutting the above desoribed premises to the center lines thereof; TOGETHER with the appurtenances, and
also all the estate which the said decedent had at the time of decedent's death in said premises, and also the
estate therein, which the party of the first part has or has power to convey or dispose of, whether individually,
or by virtue of said Will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or succassom and assigns of the party of the second part forever.
AND the party of the first part coVenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first par in compliance with Section 13 of the Lien I.aw, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any pa. rt of the total of the same for any other
purpose. The word "party' shall be construed as if it read 'parties' whenever the sense of this indenture so
requires. "

All that certain plot, piece or parcel of land, situate, lying and being at Southold, in the Town of
Southold, County of Suffolk and State of New York, bounded and described as follows:-
BEGINNING at a point on the boundary line between the premises herein described and
land formerly of Wenzel now believed to be of DiMario and ano (said point being South 48
degrees 42 minutes 50 seconds East, a distance of 254.56 feet along said boundary line from a
monument on the curved southeasterly line of Middle Road) (said point being the northerly
comer of the premises herein described and the easterly comer of land of William Herman); from
said point of beginning running along said land formerly of Wenzel South 48 degrees 42 minutes
50 seconds East, a distance of 95.01 feet to an iron pipe and land heretofore conveyed by
Madeleine R. Armstrong to Patrick J. Bagley and Dorothy E. Bagley, his wife (Liber 4907 cp
37); running thence along said land of Patrick J. Bagley and wife, two courses as follows:
(1) South 41 degrees 12 minutes 30 seconds West, a distance of 91.20 feet; thence
(2) South 48 degrees 47 minutes 30 seconds East, a distance of 5.0 feet;
running thence along land of Schmitt, South 41 degrees 12 minutes 30 seconds West, a distance
of 100.0 feet to an iron pipe on the northeasterly line of a Private Road; thence along said
northeasterly line, North 48 degrees 47 minutes 30 seconds West, a distance of 100.0 feet to land
of William Herman; thence along said land of Herman, North 41 degrees 12 minutes 30 seconds
East, a distance of 191.32 feet to the point of beginning.
TOGETHER WITH the right to the use of a right of way (in common with others) over
the following described private road:
BEGINNING at a monument on the curved southeasterly line of Middle Road at the
northerly comer of land of Levin and the westerly comer of land formerly of the party of the first
part; from said point of beginning running South 48 degrees 47 minutes 30 seconds East, a
distance of 489.0 feet to an iron pipe; thence North 69 degrees 04 minutes East a distance of
125.0 feet to an iron pipe; thence South 48 degrees 47 minutes 30 seconds East a distance of 85
feet, more or less, to ordinary high water mark of Arshamomoque Pond; thence northeasterly
along said high water mark, 35 feet, more or less, to a point 70.0 feet southwesterly from the
northeasterly boundary line of land formerly of the party of the first part (now of Johnson),
measured at right angles thereto; thence parallel to said boundary line and 70.0 feet southwesterly
therefrom, North 48 degrees 42 minutes 50 seconds West a distance of 115 feet, more or less, to
an iron pipe; thence South 41 degrees 12 minutes 30 seconds West a distance of 54.79 feet to an
iron pipe; thence South 69 degrees 04 minutes West a distance of 74.92 feet to an iron pipe;
thence North 48 degrees 47 minutes 30 seconds West a distance of 470 feet, more or less, to said
southeasterly line of Middle Road; thence southwesterly along said southeasterly line, 25 feet,
more or less, to the point of beginning.
