NELSON, both residing at 1365 Watersedge Way, Southold, New York 11971, as Tenants in Common party of the second part, WITNESSETH, that the party of the first part, in consideration of dollars, lawful money of the United States, paid by the party of the second part,' does hereby grant and release unto the party of the second part, the heirs or succesors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and ~inginthe at Bayview0 near Southold, Town of Southold, County of Suffolk and State of New York, known and designated as Lot No. 56 on a certain map entitled, "Map of Bay Haven at Southold," and filed in the Office of the Clerk of the County of Suffolk on the 22nd day of January 1959 as Map No. 2910, said Lot being more particularly bounded and described as follows: BEGINNING at a point on the southwesterly side of Watersedge Way; said point being at the northeasterly corner of the premises about to be described herein, where the same is intersected by the division line between Lots 55 and 56 on the aforesaid Map; RUNNING THENCE from said point or place of beginning along the division line between Lots 55 and 56 south 38 degrees 42 minutes 40 seconds west 100.23 feet to the northeasterly side of land now or formerly of Dickerson; THENCE along said last mentioned land north 51 degrees 17 minutes 20 seconds west 127.00 feet to the southeasterly side of land now or formerly of Blocker; THENCE along said iast mentioned land north 38 degrees 42 minutes 40 seconds east 98.64 feet to the southwesterly side of Watersedge Way; and THENCE along the southwesterly side of Watersedge way south 52 degrees 05 minutes 50 seconds east 127.00 feet to the point or place of BEGINNING. SAID PREMISES being known as 1365 Watersedge Way, Southold, New York 11971. BEING AND INTENDED TO BE the same premises conveyed to Grantor by Deed dated February 7, 2001 and recorded in the Office of the Clerk of the County of Suffolk on February 16, 2001 in Liber D00012102 at Page 989. TOGETHER with all right, title and interest, if any, of the party oftbe first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises, TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party ofthe first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
