THIS INDENTURE, made the 1st day of February , 2002 and.
BETWEEN JENNIE 0VSIANIK, residing at 45295 Main Road, Southold, New York 11971,
as surviving tenant by the entirety of BARNEY OVSIANIK, who died a resident of
Suffolk County, New York on July 22, 1977,
party ofthefirstpan, and BARNEY V. OVISINAK, residing at 5800 Alvahs Lane, Cutchogue,
New York, JOAN D. BUTLER, residing at 3982 Thrush Lane, Liverpool, New York, and
DAVID A. OATES, residing at 95 Meeting House Creek Road, Riverhead, New York,
as tenants in common,
party of the second part,
WITNESSETH, that Se party of the first pan, in consideration of ten dollars and other valuable consideration paid by
the pany of the second pa~, does hereby grant and release unto the party of the second pan, the heirs or successors and
assigns of the party of the second pa~ forever,
ALL that ce~ain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being h~e at Peconic, in the Town of Southold, County of Suffolk and State of New
York, bounded and described as follows:
c~~ Southerly by the northerly boundary line of Main Road, known as New York
State Highway, Route 25; Westerly by land now or formerly of Joseph Ovsianik, also
known as Joseph Ovsianik, also known as Joseph Oates; Northerly by lands of Mary
Hereza, also known as Mary Harris, and Easterly by Maple Lane a Private Right-of-
Way.
BEING AiqD INTENDED TO BE the same premises as conveyed by deed dated
February 8, 1973 and recorded in the Suffolk County Clerk's Office on March 22,
1973 in Liber 7365 page 180.
RESERVING, however, to the party of the first part the exclusive possession
and the use and enjoyment of the rents, issues, and profits of the above-described
premises for and during the natural lifetime of the party of the first part, with
the party of the first part to pay for all maintenance and repairs, water, gas and
sewer charges, insurance charges and taxes relating to said premises.
THIS conveyance is subject to a mortgage held by Town of Southold, Community
Development Program, dated April 22, 1994 in the amount of $14,990.00, and on
which mortgage there is now due and owing $14,990.00, without interest, and which
said mortgage the party of the second part agrees to assume and pay when it become
due upon the death of Jennie Ovsianik, the life tenant of the premises conveyed
herein, or upon the sale of the premises.
TOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consider-
ation as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
