THIS INDENTURE, made the '7 ~ day of February, Two Thousand Five
BETWEEN
JOSEPH S. CZARTOSIESKI, 1NC., whose address is 75 Peconic Lane, Peconic, New York

party of the first part, and
JOSEPH S. CZARTOSIESKI, residing at 75 Peconic Lane, Peconic, New York 11958,
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Peconic, Town of Southold, County of Suffolk and State of
New York, bounded and described as follows:
BEGINNING at a point on the southwesterly side of Peconic Lane distant 40.75 feet
northwesterly measured along the southwesterly side of Peconic Lane from the intersection of
the northwesterly side of Main Road and the southwesterly side of Peconic Lane;
RUNNING THENCE along land now or formerly of Pace, the following two courses and
distances:
(1) South 49 degrees 14 minutes 00 seconds West, 83.90 feet;
(2) North 31 degrees 27 minutes 10 seconds East, 90.80 feet to land of the Town of
Southold;
RUNNING THENCE North 48 degrees 04 minutes 00 seconds East along land of Town of
Southold, 86.59 feet to the southwesterly side of Peconic Lane;
RUNNING THENCE South 30 degrees 00 minutes 00 seconds East along the southwesterly side
of Peconic Lane, 93 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 6/1/77 and recorded 6/6/77 in the Office of the Suffolk County Clerk in Liber
8247, Page 159.
:'~OGETHER with all fight, title and interest, if any, of the party of the first part in and to any
· streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and fights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the parr/of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in complia~tce with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
fight to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
