WITNESSETH, that the party of the first pan, in consideration often Dollars and other valuable
consideration paid by the party of the second pan, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements then'on
erected, situate, lying and being at Peconic, Town of Southold, County of Suffolk and State of
New York, bounded'and described as follows:
BEGINNING at a point on the ~uthwesterly side of Peconic Lane distant 40.75 feet

northwesterly side of Main Road and the southwesterly side of Peconic I.ane:
P, UN'NING THENCE along land now or formerly of Pace. the following two courses and
distances:
(I) South 49 degrees 14 minutes 00 seconds West. 83.90 feet;
(2) North 31 degrees 27 minutes 10 seconds EasL 90.80 feet to land of the Town of
Southold;
RUNNING THENCE North 48 degrees 04 minutes 00 seconds East along land of Town of
Southold, 86.59 feet to the southwesterly side of Peeonic Lane; ' ·
RUNNING THENCE South 30 degrees 00 minutes 00 seconds East along the southwesterly side
of Peconic Lane. 93 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 2f7/2005 and recorded 3/1612005 in the Office of the Suffolk County Clerk in Libor
12376. Page 891.
TOGETHER with all right, title and interest, if any, of thc party of thc first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with thc appurtenances and all the estate and rights o£ the party of the first part in and to said
premises: 'lO HAVE AND TO HOLD the premises herein granted unto ~hc party of thc second
part, the heirs or successors and assigns o£thc pan), of the second part forever.
AND the party of thc first part covenants that the party of thc first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the l'ucst part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied llrst for the purpose of paying the cost
of the impwvement and will apply the same first to the payment of the cost of thc improvement
before using any pan of the total of thc same for any other purpose.
The word "party" shall be construed as if it read "panics" whenever the sense of this indenture so
requires.
