THIS INDENTURE, made the 5m day of June, Two Thousand Three
BETWEEN

party afthe first part, and
PAUL A. SCHINELLER, residing at 24 Turkey Lane, Cold Spring Harbor, New York 11724

WITNESSETH, that thc party of the first part, in consideration of Tcn Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
oftbe second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with thc buildings and improvements thereon
erected, situate, lying and being at Peconic, Town of Southold, County of Suffolk, State of
New York, bounded and described as follows:
BEGINNING at a point on the easterly side of Wells Road distant 1051.33 feet southerly,
when measured along the easterly side of Wells Road, from the coroer formed by the
intersection of the easterly side of Wells Road and the southerly side of Main Road (S.R. 25),
said point of beginning being the poim of intersection of the easterly side of Wells Road and
the southerly line of land now or formerly of Di Nunzio;
RUNNING THENCE southeasterly along said land now or formerly of Di Nuazio, the

473.40 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from N. Charles Deluca and Sylvia Deluca, dated April 17, 1997, and recorded May I,
1997, in the Office of the Suffolk County Clerk in Liber 11828, Page 294.
TOGETHER wilh all right, title and interest, if any, of' the party of the first part in and to any
streets and roads abutting the above described premises to thc center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of' the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns o£the party of the second part forever.
AND the party of Ibc firsl part covenants that thc part4/of the first part has not donc or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for thc purpose of'paying the
cost of the improvement and will apply thc same first to the payment of the cost o£ the
improvement before using any part of thc total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
