Bargain and Sale Deed, with Covenant against Grantor's Acts
THIS INDENTURE, made the 1 lth day of March, two thousand and two
BETWEEN
ROBERT KUHNE and VIRGINIA HARMS, his wife,
residing at 130 Midway Road, Southold, New York 11971,
party of the first part, and
HENRY KAMINER,
residing at 119 Hudson Avenue, Tenafly, New Jersey 07670
party of the second part,
WlTNESSETH, that the party of the first part, in consideration of ten dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land situate, lying and being at Cedar Beach, near
Southold, in the Town of Southold, County of Suffolk and State of New York known and
designated as lot no. 140 on a certain map entitled "Subdivision Map of Cedar Park" and filed in
the Office of the Clerk of the County of Suffolk on December 20. 1927, as map number 90, being
more particularly bounded and described as follows:
BEGINNING at a point on the Northwesterly side of Midway Road where the same is intersected
by the division line between lots 139 and 140 on the above mentioned map; said point being
distant 60.39 feet Southwesterly as measured along the Northwesterly side of Midway Road from
the Southwesterly end of the curve connecting the Northwesterly side of Midway Road with the
Southerly side of Cedar Point Drive West;
RUNNING thence from said point or place of beginning along the Northwesterly side of Midway
Road the following two courses, curves and distances:
1. South 28 degrees 20 minutes 40 seconds West 6.81 feet;
2. Southwesterly along the arc of a curve bearing to the left having a radius of 250.00 feet a
distance of 93.87 feet to the division line between lots 140 and 141;
RUNNING thence along said division line North 70 degrees 43 minutes 50 seconds West 243.64
feet to West Lake;
RUNNING thence along West Lake North 16. degrees 35 minutes 53 seconds East 100.11 feet to
the division line between lots 139 and 140 first above mentioned; and
RUNNING thence along said division line South 70 degrees 43 minutes 50 seconds East 246.64
feet to the point or place of BEGINNING.
SAID premises known as 130 Midway Road, Southold, New York.
Being the same premises conveyed by Deed dated September 14, 1994, and recorded
September 29, 1994, in Liber 11696 Page 297.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in. any 'way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the s~me for 'any other ipurpose. ~Fhe word. "party" shall'be
consti'ued as if it read "parties" whenever the sense of this indenture so requireS.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
