second part, does hereby grant and re[ease unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Cedar Beach, near Southold, Town nf
Southold, County of Suffolk and State of New York. known and designated as and by Lot No. 134 on a certain
map enbtled, 'Subdivision Map of Cedar Beach Park, situated at Bayview, Town of Southold, New York*, made
September 15, 1926. by Otto W. Van Tuyl, Professional Engineer and Surveyor. License No. 1582. which map
was filed in the Suffolk County Clerk's Office as Map No. 90 on 17../~011927.
· TOGETHER with the right to the use, in common with others, of the roads as set forth on said map arid the right
of access over the private road des,gnated as Little Peconic Bay Lane southerly to Little Peconic Bay.
TOGETHER with all the right, title and interest, if any, of the party of the first part in and to the beach, waters, and
lands under waters in front of and abutting said premises to the center lines thereof
TOGETHER with all the dghts and privileges, if any, of the party of the first part of. in and to the right to the use
of community properties designated on said map.
SUBJECT to covenants, restrictions, easements, reservations and agreements of record.
r ~eeing and intended to be the same premises acquired by the party of the first part by deed dated 1/311968 and
corded in the County Clerk's Office on11811988, in Deed L,ber 628~at Page 282.
Said premises known as 1275 West Cedar Point Drive, Peconic Bay. New York 11958
District 1000, Section 090 00, Block 01.00 and Lot 002.00
TOGETHER with all right, title and interest, if any. of the party of the first part in and to any streets and roads
al~utting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to sa,d premises; TO HAVE AND TO HOLD the premises
here,n granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part. in compliance with Section 13 of the Lien Law. covenants that the party of the first
part will receive the cons;deration for this conveyance and will hold the right to receive such consideration a~ a
trust fund to be applied first for the purpose of paying the cost of the ~mprovement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word 'party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
