Combustible insulating boards not more than 0.5-inch (12.7 mm) thick and covered with approved finished flooring are permitted, where attached di- rectly to a noncombustible floor assembly or to wood subflooring attached to sleepers as provided for in Section 804.4.1. 804.5 Interior floor finish requirements. WHEREAS, this amended site plan is for the proposed construction of a 1,650 sq. ft. addition to the existing Community Center Caf~ area, new outdoor terrace and 17 land-banked parking spaces at the Community Center on a 145.01-acre parcel in the HD, R-80 Zones located on the n/s/o NYS Route 25, 1,121' e/o Sound Road, in Greenport. SCTM#1000-35.1-25; and WHEREAS, Peconic Landing is the owner of the property located on the n/s/o NYS Route 25, 1,121' e/o Sound Road, in Greenport; and WHEREAS, on December 5, 2000, the Southold Town Planning Board approved a site plan with 118 single-family detached cottages and 132 apartments units, a 24-unit assisted living center and a 32-bed skilled facility with supporting amenities along with other site improvements and authorized the Chairperson to sign the map on December 4, 2000; and WHEREAS, on August 11, 2003, the Southold Town Planning Board approved an amended site plan for a new 25-car parking lot near the Community Center; and WHEREAS, on May 17, 2007, the agent, Bruce A. Anderson of Suffolk Environmental Consulting, Inc., working for the applicant, Peconic Landing, submitted an amended site plan application for approval; and WHEREAS, on May 21, 2007, the Southold Town Planning Board held a Work Session and accepted the application and requested additional information to be submitted from the agent, Suffolk Environmental Consulting, Inc.; and Peconic Landinq Cafeteria Addition Pa,qe Two _August 14, 2007 WHEREAS, on May 24, 2007, the Architectural Review Committee reviewed the associated site plan materials and approved the plans for expansion as submitled and the Southold Town Planning Board accepted these comments for approval; and WHEREAS, on June 1, 2007, the New York State Department of Environmental Conservation responded after review that, if the proposed project is located within 300' of the tidal wetlands boundary, a Tidal Wetlands Permit is required and the Southold Town Planning Board accepts this as a condition of approval; and WHEREAS, on June 13, 2007, the Southold Town Building Department issued a Notice of Disapproval indicating that the proposed construction requires site plan approval from the Southold Town Planning Board; and WHEREAS, on June 25, 2007, the Southold Town Building Inspector reviewed and certified the site plan with "the proposed use is permitted in this HD District" and the Southold Town Planning Board accepts this for approval; and WHEREAS, on July 6, 2007, the Suffolk County Department of Planning responded, after review, and determined that this matter is for "local determination as there appears to be no significant county-wide or inter-community impact(s)" and the Planning Board accepts this pursuant to 239 L & M General Municipal Law and the Southold Town Planning Board accepts this for approval; and WHEREAS, on July 10, 2007, William J. Lohn of Suffolk Environmental Consulting, Inc., submitted information by letter that the Suffolk County Department of Health Services has assigned Reference Number C~10-07-006 for the approval of the proposed construction and the Southold Town Planning Board accepts this for conditional approval; and WHEREAS, on July 10, 2007, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5 c (7), made a determination that the proposed action was a Type II and not subject to review; and WHEREAS, on July 10, 2007, the Southold Town Planning Board set the final public hearing for August 13, 2007 at 6:10 p.m.; and WHEREAS, on July 24, 2007, the Greenport Fire Department responded, after review of the site plan, with approval of the proposed construction "assuming that all corresponding Local and State Fire Code Requirements have been met and/or exceeded" and the Southold Town Planning Board accepts this response for conditional approval; and WHEREAS, on July 25, 2007, the Southold Town Engineer reviewed the site plan material and responded with the following recommendations: · "The proposed addition is approximately 1,580 sq. ft. in area. Drainage calculations have been provided and are considered satisfactory. This project also required the re-location of an existing septic tank. This item should be reviewed & approved and/or coordinated by the Building Department. At this time, this proposed addition appears to meet the requirements of Town Code" and the Planning Board agreed with these recommendations; and Peconic Landing Cafeteria Addition Paqe Three .Au,qust 14, 2007 WHEREAS, on July 30, 2007, Mark Terry, the LWRP Coordinator, iss,,u..ed recommendations in a letter, after review of the site plan materials, that the proposed action is CONSISTENT with the Policy Standards and, therefore, is CONSISTENT with the LWRP" and the Southold Town Planning Board accepts this recommendation for approval; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 55, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, the following items shall be required: All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. The lighting must meet Town Code requirements. 2. All signs shall meet Southold Town Zoning Codes and shall be subject to approval of the Southold Town Building Inspector. 3. As per the Landscape Survivability Guarantee, the applicant agrees to replace any of the landscaping which dies within three (3) years of planting; therefore, be it RESOLVED, that the Southold Town Planning Board has reviewed the proposed action under the policies of the Town of Southold Local Waterfront Revitalization Program and has determined that the action is consistent with the Policy Standards as noted in the July 30, 2007 report prepared by the LWRP Coordinator; and be it further RESOLVED, that pursuant to Southold Town Code 280-131 Part I, the applicant agrees to incorporate all the requirements, comments, and recommendations of each reviewing agency as referenced above and as indicated on the site plan and corresponding attachments; and be it further RESOLVED, that the Southold Town Planning Board grant approval on the site plan set Sl-S2 with the architectural plan set Al-A2 prepared by Ashley McGraw Architect Services, P.C., and certified by Dominic LaPierre, Architect, dated May 11,2007, and the Re-vegetation Plan prepared by Suffolk Environmental Consulting Services, dated May 4, 2007, and authorize the Chairperson to endorse the site plan with the following conditions: 1. The section also indicates that smoke detectors are not required when smoke detectors are installed in the areas served by the system. In the case of the Peconic Landing, the largest system in the affected area has a design flow of 2,000 CFM and the spaces served are also equipped with smoke detectors. Scope 1. Expanded vinyl walI coverings shall comply with the requirements for textile wall and ceiling materials and their use shall comply with Section 803.6. Exception: Expanded vinyl wall or ceiling coverings com- plying with Section 803.2 shall not be required to comply with Section 803.1 or 803.6. 803.8 Insulation. Thermal and acoustical insulation shall comply with Section 719. 803.9 Acoustical ceiling systems. The quality, design, fabrica- tion and erection of metal suspension systems for acoustical tile and lay-in panel ceilings in buildings or structures shall conform with generally accepted engineering practice, the pro- visions of this chapter and other applicable requirements of this code. 803.9.1 Materials and installation. Acoustical materials complying with the interior finish requirements of Section 803 shall be installed in accordance with the manufacturer's recommendations and applicable provisions for applying interior finish. 803.9.1.1 Suspended acoustical ceilings. Suspended acoustical ceiling systems shall be installed in accor- dance with the provisions of ASTM C 635 and ASTM C 636. 803.9.1.2 Fire-resistance-rated construction. Acousti- cal ceiling systems that are part of fire-resistance-rated construction shall be installed in the same manner used in the assembly tested and shall comply with the provi- sions of Chapter 7. SECTION 804 INTERIOR FLOOR FINISH 804.1 General. Interior floor finish and floor covering materi- als shall comply with this section. Exception: Floors and floor coverings of a traditional type, such as wood, vinyl, linoleum or terrazzo, and resilient floor covering materials which are not comprised of fibers. 804.2 Classification. Interior floor finish and floor covering materials required by Section 804.5.1 to be of Class I or Il ma- terials shall be classified in accordance with NFPA 253. The classification referred to herein corresponds to the classifica- tions determined by NFPA 253 as follows: Class 1, 0.45 watts/cra2 or greater; Class II, 0.22 watts/cm2 or greater. 804.3 Testing and identification. Floor covering materials shall be tested by an approved agency in accordance with NFPA 253 and identified by a hang tag or other suitable method so as to identify the manufacturer or supplier and style, and shall indicate the interior floor finish or floor covering classifi- cation according to Section 804.2. Carpet-type floor coverings shall be tested as proposed for use, including underlayment. Test reports confirming the information provided in the manu- facturer's product identification shall be furnished to the code enforcement official upon request. 804.4 Application. Combustible materials installed in or on floors of buildings of Type I or II construction shall conform with the requirements of this section. Exception: Stages and platforms constructed in accordance with Sections 410.3 and 410.4, respectively. 804.4.1 Subfloor construction. Floor sleepers, bucks and nailing blocks shall not be constructed of combustible mate- rials, unless the space between the fire-resistance-rated floor construction and the flooring is either solidly filled with approved noncombustible materials or fireblocked in accordance with Section 717, and provided that such open spaces shall not extend under or through permanent parti- tions or walls. 804.4.2 Wood finish flooring. Wood finish flooring is per- mitted to be attached directly to the embedded or fireblocked wood sleepers and shalI be permitted where ce- mented directly to the top surface of approved fire-resis- tance-rated construction or directly to a wood subfloor attached to sleepers as provided for in Section 804.4. l. 804.4.3 Insulating boards. Combustible insulating boards not more than 0.5-inch (12.7 mm) thick and covered with approved finished flooring are permitted, where attached di- rectly to a noncombustible floor assembly or It wood subflooring attached to sleepers as provided for in Section 804.4.1. 804.5 Interior floor finish requirements. In all occupancies, interior floor finish in vertical exits, exit passageways, exit ac- cess corridors and rooms or spaces not separated from exit ac- cess corridors by full-height partitions extending from the floor to the underside of the ceiling shall withstand a minimum criti- cal radiant flux as specified in Section 804.5.1. 804.5.1 Minimum critical radiant flux. Interior floor fin- ish in vertical exits, exit passageways and exit access cord dors shall not be less than Class I in Groups I-2 and I-3 and not less than Class II in Groups A, B, E, H, I- 4, M, R- 1, R-2 and S. In all other areas, the interior floor finish shall comply with the DOC FF-I "pill test" (CPSC 16 CFR, Part 1630). Exception: Where a building is equipped throughout with an automatic sprinkler system in accordance with Section 903.3.1. l, Class Il materials are permitted in any area where Class I materials are required and materials complying with DOC FF-I "pill test" (CPSC 16 CFR, Part 1630) are permitted in any area where Class II mate- rials are required. · -~ [F] SECTION 805 DECORATIONS AND TRIM 805.1 General. I. 1 and the material is installed in accordance with Section 803.4. 805.2 Acceptance criteria and reports. Where required to be flame resistant, decorative materials shall be tested by an ap- proved agency and pass Test 1 or 2, as appropriate, described in NFPA 701 or such materials shall be noncombustible. Reports of test results shall be prepared in accordance with NFPA 701 and furnished to the code enforcement official upon request. 805.3 Foam plastic. Foam plastic used as trim in any occu- pancy shall comply with Section 2604.2. 805.4 Pyroxylin plastic.
