AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the fight to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. AND the party of the first part covenants as follows: that said party of the first part is seized of the said premises in fee simple, and has good right to convey the same; that the party of the second part shall quietly enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid; that the party of the first part will execute or procure any further necessary assurance of the title to said premises; and that said party of the first part will forever warrant the title to said premises. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires. R S j~ETTIT JR SCHEDULE A ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Cedar Beach Park, Suffolk County, State of New York, known and designated as Plot No. 99, on a certain map entitled, "Subdivision Map Cedar Beach Park, situate at Bayview Town of Southold, New York," surveyed and certified by Otto W. Van Tuyl, Engineer and Surveyor, and filed in the Office of the Clerk of the County of Suffolk, as Map No. 90. TOGETHER with an easement for ingress and egress over all streets, roads, drives, and lanes as laid down on said map; and also the right to ingress and egress in and to any of the Inlets, Basis or Harbors on said map, and to moor a boat in Cedar'Beach Harbor. TOGETHER with all the right, title and interest of the grantor if any, in and to land in front of said premises under water in the Peconic Bay, and all grantor's riparian rights thereto. TOGETHER with the right to mn with the land, to use and enjoy in common with others enjoying similar rights and privileges, those portions of Cedar Beach Park, which have been or may hereinafter be set aside for Community purposes as such rights and privileges are set forth in Liber. 1375 cp 35. ~ It is the intention of this deed that the Grantors, ROBERT HALSEY PETTIT, JR.,' CYNTHIA PETTIT SCHOCH and DAVID HOWELL PETTIT, owners in common of a 25% interest in the premises each to the extent of eight and one-third percent (8 1/3%), and ROBERT HALSEY PETTIT, owner of twenty-five percent (25%) interest, convey such portion of their respective interests to JAMES CORWIN PETTIT, so that, after such conveyance, said ROBERT HALSEY PETTIT, JR., CYNTHIA PETTIT SCHOCH, DAVID HOWELL PETTIT, and JAMES CORWIN PETTIT will each possess an equal twelve and one-half percent (12 1/2%) interest totaling fifty percent (50%) of the property.
