PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 25,000 square feet and is improved with a one-story frame dwelling with garage and porch, and an accessory 8.2 ft. by 12.2 ft. shed located in the rear yard. BASIS OF APPLICATION: Zoning Code Section 280-124 (100-244 based on the Building Inspector's May 24, 2006 Notice of Disapproval) concerning a proposed addition to the existing dwelling at less than the code-required 15 feet from the side property line FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 30, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant requests a side yard setback yard variance to construct a proposed 15 ft. x 16 ft. addition behind the dwelling. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the ne~hborhox)d~r axletdment to~earby properties. The dwelling has a pre-existing~side yard setback at 10.9 feet, and the proposed addition will maintain the same building line that exists at the side of the dwelling. The proposed 255 square foot addition is small, well screened from the neighbors to the east, and will not be visible from the street. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling has a pre-existing side yard setback of 10.9'. Although the owner/applicant's proposed addition will maintain the existing side yard setback, because the subject property narrows slightly toward the southerly (rear yard) boundary, the required side yard setback for the proposed addition is 10.1' at the southeast corner. 3. The variance granted herein ~ not substantial. 4. The difficulty has been self-created but is the result of a pre-existing non-conforming side yard setback. 5. No evidence has been submitted to suggest that the variance relief will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition to the existing dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the August 12, 2005 site survey prepared by Peconic Surveyors, P.C. and the June 2006 elevation diagram prepared by Charles A. DiGiovanna, R.A. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
