the benefit of Richard Coster,Jr., andk K. CUMMINGS,as to the remaining fifty(50%)percent interest,as

WITNESSETH,that the party of the first part in consideration of

party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and

PARCEL ONE: ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,
situate, lying and being in the Nassau Point or Little Hog Neck, in the Town of Southold, County of Suffolk and State
of New York,known and designated"Fisherman's Beach" Lot 6 and filled area between Lot 6 and the ordinary high
water line of Cutchogue Harbor,as shown on a certain map entitled"Subdivision Map, Peconic Bay Properties, Inc.,
surveyed February 6, 1931 by Otto W. Van Tuyl, Surveyor"',filed in the Suffolk County Clerk's Office on April 5,
1931 as No.786 of Maps,which said lot and filled area when taken together are bounded and described as follows:
BEGINNING at a point on the southerly side of Haywaters Road(Private Road)where the division line between Lots 5
and 6 as shown on aforesaid map intersects same; RUNNING thence along the said division line South 19 degrees 16
minutes 20 seconds West 243.0 feet to the ordinary high water mark of Cutchogue Harbor;RUNNING THENCE
along said ordinary high water(nark on a tie line having a bearing of North 54 degrees 20 minutes 50 seconds West
for a distance of 78.49 feet;RUNNING THENCE North 22 degrees 20 minutes 20 seconds East 239.0 feet to the
Southerly line of Haywaters Road;RUNNING THENCE along the Southerly line of Haywaters Road South 54 degrees
50 minutes 10 seconds East 65.0 feet to the point or place of BEGINNING
PARCEL TWO: ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,
situate,lying and being in the Nassau Point or Little Hog Neck, in the Town of Southold, County of Suffolk and State
of New York,known and designated as"Fisherman's Beach" the easterly 50 feet of Lot No. 30 as shown on a certain
map entitled"Subdivision Map,Peconic Bay Properties, Inc.,surveyed February 6, 1931 by Otto W. Van Tuyl,
Survevorl".filed in the Suffolk County Clerk's Office on April 5. 1931 as No. 786 of Maps, which part of lot is
bounded and described as follows:
BEGINNING at a point on the northerly side of Haywaters Road, where the division line between lots 30 and 31,as
shown on aforesaid map, intersects same;RUNNING THENCE along the northerly side of Haywaters Road, North 54
degrees 50 minutes, 10 seconds West 50.0 feet;THENCE North 35 degrees 09 minutes 50 seconds East, 70 feet, more
or less,to the ordinary highwater mark of Haywaters Cove;THENCE in a general easterly direction along the ordinary
highwater mark of Haywaters Cove,for a distance of 50 feet, more or less, to the division line between Lost 30 and 31,
as shown on the aforesaid map;THENCE along said division line behveen lots 30 and 31, South 35 degrees 09
minutes 50 seconds West,60 feet,more or less, to the northerly side of Haywaters Road and the point or place of

1 Subject to a certain Agreement,dated the 3r day of October, 1998, executed by ANNA K. CUMMINGS and
ddd RICHARD COSTER, JR, and intended to be recorded simultaneously herewith.
Said premises being known as and by Haywaters Road, Cutchogue,New York.
The grantor herein being the same party as the grantee in a deed dated December 31, 1987,and recorded in Liber
10525,Page 591,in the Suffolk County Clerk's Office on January 28, 1988.
TOGETHER with all right,title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof,TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said Drcnrises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successor;and assigns of the party of the second part 0rever.
AND the party of the first party covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word
"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
