entitled "Map of Goose Neck, situate at Bay View, Town of Southold, Suffolk County,
N.Y., owned by G. W. Smith & Sons," made by Otto W. Van Tuyl, Licensed Surveyor,
Greenport, N.Y., and filed in the Suffolk County Clerk's Office on November 22, 1948,
as and by File No. 1663, bounded and described as follows:
BEGINNING at a point formed by the intersection of the southerly side of
Smith Drive North and the easterly side of Terry Place;
RUNNING THENCE North 80 degrees 30 minutes East, 103.22 feet along the southerly
side of South Drive North;
THENCE South 26 degrees 12 minutes East, 104.40 feet;
THENCE South 32 degrees 24 minutes 34 seconds West, 33.74 feet (29.65 feet
map);
THENCE North 51 degrees 00 minutes West, 167.04 feet along the easterly side
of Terry Place to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the.the grantor herein
by Certificate No. 40277 as transferred in Liber 12067 page 446.
TOGETHER with the right to use, for all reasonable purposes, in con,non with others,
subject to such reasonable rules and regulations with respect to the use thereof as the
party of the first part may from time to time put into effect, that portion of Lots
No. 37 and 38 on said map, known as the beach property, it being the intention of the
party of the first part to grant to the parties of the second part the same rights that
it has heretofore granted to other grantees of lots on said map.
TOGETHER in common with others the right of way over lot No. 50A to Canal.
TOGETHER with all fight, rifle and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereo~ TOGETHER with the appurtenances, and also all
the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein,
which the party of the flint part has or has power to convey or dispose oL whether individuaily, or by vi~ue of smd
will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heim or successors and assigns of the party of the second part forever.
AND the party of the f'Lrst part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been incumbered in any way whatever, except as aforesaia.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
