abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and ass!gns of the party of the second part forever.
AND the party of the first l~art, in complianc[ with Section 13 of the Lien Law, covenants that the party of the first
)art will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, situate, lying and being in the
Town of Southold, County of Suffolk and State of New York, known and
designated as the Park and ReCreational Area including the footpath as shown
on Map of Paradise By The Way, filed 11/4/76 as Map Number 6463, said
footpath which runs along the southerly side of Lot 2 on the above mentioned
Map and continues along the ~ side of Lots 3 and 4 to the Park and
Recreational Area is partially descried on the South and West as follows:
BEGINNING at a point on the easterly side of Kimberly Lane and the
southwesterly side of the footpath about to be partially described;

THENCE South 00 degrees 24 minutes 00 seconds East 28.92 feet;
THENCE South 02 degrees 19 minutes 40 seconds East 76.13 feet;
