THIS INDENTURE, made the ~'--~day of June

SUSAN'McGUIRE EWING and CAROL A. McGUIRE MEREDITH, Executors'of
the Last Will and Testament of Judith A. McGuire, dec'd., residing
at 40 Forest Drive, Hillsdale, New Jersey 07642, and 75 Hoffman
Court, River Vale, New Jersey 07675, respectively,
party of the first part,
AND
SUSAN McGUIRE EW~N~.residing at 40 Forest Drive, Hillsdale, NeW
Jersey 07642, and CAROL A. McGUIRE MEREDITH, residing at 75
Hoffman Court, River Vale, New Jersey 07675, in the following
estates and proportions: An undivided one-half (½) interest
unto the said SUSAN McGUIRE EWING, her heirs and assigns; and
an undivided one-half (}} interest unto the said CAROL A.
McGUIP~ MEREDITH, her heirs and assigns; both as tenants in
parties of the second part,
WITNESSETB, that the party of the first part, in consideration of
Ten Dollars and other valuable consideration paid by the parties
of the second part, does hereby grant and release unto the parties
of the second part, the heirs or successors and assigns ok the
parties of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being in the
Town of Southold, County of Suffolk and State of New York, being
more particularly bounded and described as follows:
BEGINNING at a point where the northerly ~ide of North!Parish¢:Drive
intersects the Easterly side of Northfield Lane;
RUNNING THENCE along the Southerly line of Parcel I herein, South
82 degrees 30 minutes East 30.57 feet;
RUNNING THENCE along the Easterly line of Parcel I herein, North
18 degrees 35 minutes 10 seconds East, 300 feet more or less to
the ordinary high water mark of Peconic Bay;
THENCE along the ordinary high water mark of Peconic Bay'in the
easterly direction as it winds and turns, 335 feet more or less
to land now or formerly of Reese;
RUNNING THENCE along land now or formerly of Reese, South 24
degrees 06 minutes 00 seconds West, 280 feet more or less to a
point and land now or formerly of Quinn;
RUNNING THENCE along land now or formerly of Quinn, North 82
degrees 30 minutes 00 seconds West, 317.09 feet to a monument at
the easterly side of Northfield Lane;
RUNNING THENCE along the easterly side of Northfield Lane, North
7 degrees 30 minutes East, 25 feet to the northerly line of North
Parish Drive, to the point or place of BEGINNI.NG.
BEING also known as Section 071, Block 01.00, Lot 016.000 on the
Tax Map of the Town of Southold.
BRING the same premises conveyed to Judith A. McGuire, as Trustee
of the Judith A. McGuire .New York Qualified Personal Residence
Trust, by deed from Judith A. McGuire, dated December 3, 1999,
and recorded in the Suffolk County Clerk's Office on April 18,
2000 in Deed Liber 12035 at Page 529. The said Judith A. McGuire
died on the 9th day of June, 2001, leaving a L~st Will and
Testament, probated in the Bergen County, New Jersey, Surrogate's
Court on July 9, 2001, and appointing the above named parties of
the first part as Executors.
The purpose of the within Deed is to transfer title to the subject
premises to Susan McGuire Ewing and Carol A. McGuire Meredith,
sole beneficiaries of the estate of Judith A. McGuire under the
said Last Will and Testament of Judith A. McGuire, without
consideration.
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above-described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party
of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the parties of the second part,
the heirs or successors and assigns of the p~rties of the second
part forever.
AND the party of the first part covenants that the party of the
first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13
of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for
a~y other purpose.
The-word "party" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
