New York 11971,
party of the first part, and
PETER MOLLICA and DIANE MOLLICA, husband and wife, residing at 1424 83td Street,
Brooklyn, New York 11228,
party of the second part,
WITNESSETH, that thc party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by thc party of the second part, does hereby grant and release unto thc party
of the second part, the heirs or successors and assigns oft he party of lhe second part forever,
ALL that certain CoL piece or parcel of land, with the buildings and hnprovements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, known and designated as Lot No. 3, as shown on a certain map entitled, 'Map of
Harbor Lights Estates, Section One, Bayvicw T~Jwn of Suuthold, Suffolk County, New York'
made by Otto W. Van Tuyl & Son, licensed land surveyors, Greenpon, New York. and filed
in the Office of thc Clerk of the County of Suffolk on June 8, 1965, as Map No. 4362.
Together with the following parcel:
BEGINNING at a point on the easterly line of Lot 2, '/dap of H'4rbor Lights Estates Section
1' filed in the Suffolk County Clerk's Office as Map #4362. 75.0 feet northerly along said
easterly line from the southeastern comer of said Lot 2, from said point of beginning running
along said Lot 2, two courses:
(1) North 25 dcgrecs 54 minutes 50 seconds East 25.00 feet;
(2) THENCE South 64 degrees 05 minutes 10 seconds East 22.56 feet;
THENCE along a dredged canal. South 16 degrees O1 minutes 00 seconds West 25.38 feet;
THENCE along Mooring plot I6A, North 64 degn:es 05 minutes 10 seconds West 26.92 feet
to the point of boginning.
' TO(~THER with an easement by foot only over the most northerly five feet of Lots #16 and
· #15, as shown and laid out on the above-mentioned map and continuing northerly along a strip
of land $ feet wide contiguous to the easterly boundary line of Lot g2, as shown and laid out
on the above-mentioned map a distance of 76 feet or more, to the southerly line of the
description parcel.
TOGETHER with all lands under water contiguous to the premises above-described owned by
the party of the first part.
TOGETHER with an easement of egress and ingress over the streets and roads shown on said
filed map out to the nearest legal highway.
TOGETHER with an easement for boating purposes, in common with others, over a strip of
land .50 feet in width, extending from the northerly line of LOt #14 in a north/nortbeasterly
direction to Southold Bay (Peconic Bay on subdivision map) for ingress and egress to said hay.
TOGETHER with thc usc, in common with others, of thc beach area and parking a~ 'adjacent
thereto, said beach area having a depth of approximately 50 f~t from the average high water
mark on Peconic Bay and having a length of 900 feet more or less measured along the ordinary
high water mark, and said parking area having a frontage on the northerly side of Harbor
Lights Drive of approximately 150 feet, running westerly along said street from Lot #7, and
having a depth of not less than 150 feet northerly of Harbor Lights Drive, the parking area
shall be immediately adjacent to and continguous to the beach area herein referred to. Said
beach and parking area shall be for the sole use and benefit of the residents of Harbor Lights
Estates, comprising a development of approximately 12~ acres.
BEING AND INTENDED TO BE the same premises conveyed to the party of the la'st part by
deed from Russell V. Broach, dated 9112/80, and recorded 9/24/80, in the Office of the
Suffolk County Clerk in Liber 8886, Page ~52.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGI:THER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premisas; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns oftbe party of the second part forever.
AND the party of the first part covenants that the party of the first pan has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of Ihe first pan will receive the consideration for this conveyance and will hold the
right to receive such eonsideralion as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply Ihe same first to the payment of the cost of the
improvement before using any part of the total oftbe same for any other purpose.
The word "party" shall bo construed as if it mad ~partics# whenever the sense ofthis indenture so
