erected, situate, lying and being in Peconic, Town of southold. County of Suffolk, State of New
York, more particularly bounded and described as follows:
BEGINNING at a point formed by the intersection of the northerly side of Middle Road (C.R.
48) and the easterly line of the lands of Cutchogue Associates and the westerly line of thc parcel
about to be described, being the true point or place of beginning;
RUNNING from said point of beginning, North 44 degrees 44 minutes 20 seconds West, a
distance of 5073.24 feet along the lands formerly of Cutehogue Associates to thc Long Island
Sound;
THENCE North 72 degrees 22 minutes 09 sccon,ts East, a distance of 190.33 feet on a tie linc
along the ordinary high water of the Long Island Sound;
THENCE North 66 degrees 01 minute 40 seconds East, a distance of 21.39 feet, still on a tie line
along the ordinary high water ofthc Long Island Sound to the lands of Mark A. Angel,eon;
THENCE South 44 degrees 44 minutes 20 seconds East, a distance of 421.37 feet along the
lands of Mark A. Angeison;
THENCE South 45 degrees 15 minutes 40 seconds West, a distance of 164.42 feet still along the
lands of Mark A. Angelson;
THENCE along the lands of Mark A. Angelson, then Herodotus Damianos, South 44 degrees 44
minutes 20 seconds East, a distance of 4568.71 feel to the northerly line of Middle Road (C.IL
48);
THENCE along the northerly line of Middle Road (C.R. 48), South 69 degrees 17 minutes 48
seconds West, a distance of 27.37 feet, to the point or place ofbeginning. Containing 4.65 acres,
more or less.
SUBJECT to a certain right-of-way simultaneously conveyed to certain property now or
formerly of Mark A. Angelson, said property being to the .south and east of the subject property.
TOGETHER with all right, title and interesl, ifany, of the party oftbe first part of, in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
pan, the heirs or successors and assigns ofthe party oftbe second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
riehl to receivc such consideration ns a trust fund to be applied first for thc purpose of paying the
cosl of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose. The word
"party" shall be construed as if it read '~rties" whenever the sense of this indenture so requires.
