Widirstky, -EIGHTY THOUSAND and 00/100 ....................... dollars, ............. ($80,000.00) ............. paid by the party of the second part, does hereby grant and release unto the party of the second part, the distributees or successors and assigns of the party of the second part forever, and beinginthe on the northerly side of Carroll Avenue at Peconic, in the Town of Southold, County of Suffolk, and State of New York, bounded northerly by land formerly of Oriette M. Corwin, now of Golis, for a distance of 278' more or less; easterly by land formerly of Konarski, now of Sakowicz, for a distance of 185' more or less; southerly by land formerly of A. Kowalewicz, now of Marczewski, for a distance of 270' more or less; westerly by Carroll Avenue for a distance of 185' more or less, containing by estimation (1) acre, more or less. SUBJECT to any state of facts an accurate survey may show, provided the same does not render the title thereto unmarketable. SUBJECT to any state of facts and inspection of the premises may show. BEING AND INTENDED TO BE the same premises as conveyed by Deed dated May 31, 1951 from Rosalind C. Newell to Joseph Francis Widirstky and Bertha P. Widirstky, his wife, and recorded in the Suffolk County Clerk's Office on June 11, 1951 in Liber 3225 page 476. Joseph Francis Widirstky, having died on October 20, 1985, leaving Bertha P. Widirstky his surviving spouse. Bertha P: Widirstky, having died a resident of Suffolk County on November 11, 2001 testate, whose will was admitted to probate on January 22, 2002 (Surrogate's File No. 89 P 2002). TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate therein, which the party of the first part has or has power to convey or dispose of, whether individually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the distributees or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. Subject to the trust fund provisions of section thirteen of the Lien Law. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
