BEGINNING at a monument on the comer formed by the intersection of the southerly side o1'
Custer Avenue with the westerly side of Bennett Lane;
RUNNING THENCE South'09 degrees 40 minutes 40 seconds West along thc westerly side of
Bennett Lane, 175.10 feet to a point;
THENCE North 78 degrees 22 minutes 50 seconds West, 120.94 feet to a point;
TIIENCE North I I degrees 37 minutes 10 seconds East. 175.10 feet to the southerly side of
Custer Avenue;
TIIENCE South 78 degrees 22 minutes 50 seconds East along the southerly side of Custer
Avenue, 115.00 feet to the monument first above mentioned at the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to thc party of thc first part and
Frances S, Gaddis by deed from Ruth T, Houston dated June g, 1967, and recorded in the Suffolk
County Clerk,s Office on June 13. 1967, in Liber 6167 page 32.
RESERVING. HOWEVER. a legal life eslate in the above-described premises with the buildings
and improvements thereon erected, in and to the party ofthe first part.
. THE PARTY OF TIlE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOhXH'MENT, exercisable as oRen as he may choose, to change his remainderman as
follows:
TO or among any onc or more members of a class consisting of thc party of thc first pan's
descendants, in any degree, whether presently living or bom hereafter, in such proportions and
amounts, without regard to equality, outright or in tmsl, as the party of the first part may direct
and appoint during his lifetime by a properly wrilten and acknowledged instrument, and recorded
prior to death, making specific reference to this power ofappointment. The party of the first part
may not appoint himself, his estate, his creditors or the creditors of his estate, under any
circumslances.
TOGETHER with all right, title and interest, if any, of thc party of the first pan in and to any
strecL~ and roads abutting Ihe above described premises to the center lines thercol~ TOGETHER
with the appurtenances and all the estate and fights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or sucecssors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby thc said premises have been encumbemi in any way whatever, except as
aforesaid.
AND thc party of the first pan, in compliance with Section 13 of the Lien Law. covenants that
the party of thc first pan will receive the consideration for this conveyance and will hold the
fight to reccive such consideration as a Irus! fund to be applied firsl for Ihe purpose of paying the
cosl of the impmvamcnt and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the ~nse of this indenture so
requires.
