ClAGLO, Jr., residing at 1825 Main Bayview Road, Southold, New York 11971 party of the second part, /~' '~'~/'-~ ~ ~'f'f/"f'/'g?/fJ WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, situate, lying and being at Bayview near Southold, in the Town of Southold, County of Suffolk and State of New York, and being known as and by Lot 4 on a certain map entitled "Map of Deerfield Farms" and filed in the Suffolk County Clerk's Office on 3/27/01 as Map No. 10596, said lot being more particularly bounded and described as follows: BEGINNING at a point on the northeasterly side of Main Bayview Road distant westerly 428.83 feet as measured along same from the intersection of the northeasterly side of Main Bayview Road with the westerly side of Jacobs Lane; RUNNING THENCE still along the northeasterly side of Main Bayview Road North 47 degrees 35 minutes 11 seconds West, 100.00 feet to land now or formerly of Storm; RUNNING THENCE North 31 degrees 22 minutes 20 seconds East, 671.31 feet to land shown on the Map of Crowley Estates, Map No. 8236; RUNNING THENCE along RUNNING THENCE South RUNNING THENCE South said lands, South 59 degrees 30 minutes 20 seconds East, 186.06 feet; 28 degrees 18 minutes 10 seconds West, 300.00 feet; 52 degrees 43 minutes 18 seconds West, 148.76 feet; RUNNING THENCE South 42 degrees 24 minutes 49 seconds West, 260.00 feet to the northeasterly side of Main Bayview Road at the point or place of BEGINNING. BEING and intended to be a part of the same premises conveyed to the party of the first part by Daniel T. McCarthy, Thomas J. McCarthy, Joseph P. McCarthy and Robert M. McCarthy by deed dated March 7, 2001 and recorded in the Suffolk County Clerk's Office on March 8, 2001 in Liber 12106, Page 541, which was to effectuate a lot line change as a condition to the approval by the Town of Southold for the subdivision of the property of which these premises are a part. The original source of title to the party of the first part was by deed from Chester Dickerson and Parker E. Dickerson, Individually and as Specific Devisees under the Last Will and Testament of Mahlon D. Dickerson, deceased, late of Suffolk County, said deed dated September 10, 1998 and recorded on September 24, 1998 in Liber 11919 Page 31. The premises is entirely owned by the transferror. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvements and will apply the same first to the payment of the cost of the improvements before using any part of the total of the same for any other purpose. AND the party of the first party covenants' as follows: that said party of the first part is seized of the said premises in fee simple, and has good right to convey the same; that the party of the second part shall quietly enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid; that the party of the first part will execute or procure any further necessary assurance of the .title to said premises; and that said party of the first part will forever warrant the title to said premises. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
