DAPCIC, residing at 390 Breistadt Court, Southoid, New York, 11971, as surviving tenant by the entirety of Nicholas Dapcic who died on September 13, 2001 party of the first part, CHRISTOPHER P. LAPPE ~ .... --L'~5"_-. - ~--v. :, both residing at 2600 South Harbor Road, Southold, New York, 11971, ~ party of the second part, WITNESSETH, that the party of the first part, in consideration of TEN ($10.00) dollars, lawful money of the United States paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the SEE SCHEDULE "A" ANNEXED HERETO TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the abov~ described premises to the center lines thereof. TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said >remises. FO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires. SCHEDULE "A" ALL THAT CERTAIN PLOT, piece or parcel of land, situate, lying and being at Southold, in the Town of Southold, County of Suffolk and State of New York, designated as Lot No. 13 on a certain Map entitled, "Southfield Park", filed in the Suffolk County Clerk's Office on December 27, 1966 as Map No. 4770, said Lot being more particularly bounded and described as follows: BEGINNING at a point on the easterly side of Breitstadt Court where same is intersected by the division line on Lots 14 and 13 on the above mentioned Map; THENCE along the easterly side of Breitstadt Court, North 9 degrees 40 minutes 40 seconds East 80.0 feet; THENCE along an arc ora curve bearing to the right having a radius of 23.82 feet, a distance along said curve of 38.56 feet to the southerly side of Custer Avenue; THENCE along the southerly side of Custer Avenue the following two (2) courses and distances: 1. South 77 degrees 33 minutes 40 seconds east 78.83 feet; 2. South 84 degrees 47 minutes 00 seconds east 96.17 feet. THENCE South 5 degrees 13 minutes 00 seconds West 107.82 feet to the first above mentioned division line; THENCE along said division line, North 80 degrees 19 minutes 20 seconds West 207.97 feet to the easterly side of Breistadt Court and the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated November 24, 1973 recorded in the Office of the Clerk of the County of Suffolk on November 27,1973 in Liber 7539 page 203.
