WITNESSETH:
That the party of the first part, in consideration of TEN ($10.00) DOLLARS, lawful
money of the United States, and other good and valuable consideration, paid by the party of the
second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
ALL that certain piece or parcel of real property, with the improvements therein
contained, situate and being a part of the Condominium in the ]'own of Southold, Suffolk
County, and State of New York, 'known and designated as Unit No. 2lB, together with a 3.20%
undivided interest in the Common Elements of the Condominium hereinafter described as the
same is defined in the Declaration of Condominium hereinafter referred to. This Unit is also
known as 305 Bayview Road (Unit 2lB), Southold, New York and is designated as District
1000, Section 097.00, Block 05.00, Lot 020.000 on the Suffolk County land and tax map ..
The real property above described is a Unit shown on the plans of a Condominium
prepared and certified by Robert Tast, Arichtect, and maps filed by Young & Young, Licensed
Surveyor, and filed in the Office of the Clerk of Suffolk County on the 25tnday of August 1989,
as Map No. 219, defined in the Declaration of Condominium entitled,. "The Cove at Southold
Condominium" made by The Cove at Southold, Inc., under Article 9-B of the New York Real
Property Law dated 25ui day of August, 1989, and recorded in the Office of the Clerk of Suffolk
County on the 25th day of August 1989, in Liber 10917 of Conveyances, at Page 477, covering
the property therein as described. The land area of the property is described as follows:
All that certain plot, piece or parcel of land, situate lying and being at Bayview, in
the Town of Southold, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING in the northwesterly comer thereof at a point in the southerly side
of Main Bayview Road, sometimes called North Bayview Road, distant South 64
degrees 07 minutes east as measured along the southerly side of said road 12 feet
from a monument set in the northwesterly comer of land of Sophie Anderson;

RUNNING THENCE South 64 degrees 07 minutes cast along the southerly side
of said roat 230 feet to the westerly line of other land of William Victoria and
Regina G. Victoria;
RUNNING THENCE the following two courses and distances along thc last
mentioned land, to-wit:
1. South 25 degrees 53 minutes west 250 feet to a coroer;
2. South 64 degrees 07 minutes cast 110.00 feet to thc center line of a
channel or boat basin leading southerly into Corey Creek;

Together with the benefits and subject to the burdens of the Declaration of Condominium
and By-Laws attached thereto recorded by the Sponsor, The Cove at Southold, Inc., dated
August 25, 2989 and recorded in the Office of the Clerk of Suffolk County on thc 25~' day of
August 1989, in Liber 10917 o£Conveyances at Page 477 and any present or future amendments
to said Declaration.
Being and intended to be the same premises conveyed to the party ofthe first part by
deed dated 1 !/6/89 and recorded 1 !/21/89 in the office of the Suffolk County Clerk in Reel
109"/0 page 42, made by The Cove at Southold, Inc.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
The use for which the Unit is intended is that of a one-family residence, subject to thc
applicable governmental regulations and the restrictions contained in the Declaration.
Thc premises herein granted unto thc party of the second part are transferred subject m
that certain mortgage with respect to such premises made ! 1/6/89 by the party ofthe first part to
EAB Mortgage Company, Inc., and currently held by ABN AMRO Mortgage Group, Inc., and
recorded 11/21/89 in the Officc of the Suffolk County Clerk in Reel 1:5579 page 208.
AND the party of the first part covenants that thc par~y of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the tirst part, in compliance with Section ! 3 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to thc payment of the cost of the
improvement before using any part o the tolal of the same for any other purpose.
The Grantee herein, by taking title to the premises above described, hereby becomes a
member of Bayview Water Homeowners Association, Inc., a not-for-profit corporation, which
holds or will hold title to the certain land by which the water supply system servicing the
Condominium is located. Grantor and Granlee both covenant that membership in the Bayview
Water Homeowners Association, Inc. is a condition of ownership of the premises herein
conveyed and the ownership and membership cannot be separated. Tha transfer of title to the
premises set forlh herein, by operation thereof, transfers membership in ~e Bayview Water
Homeowners Association, Inc. Grantee herein, and the heirs, successors and assigns of the
(3rantee, covenant that they will abide by all rules and regulations and pay all assessments which
may be imposed by Bayview Water Homeowners Association, Inc. in order to maintain the water
supply system.
The word "party" shall be construed as if it reads "parties" whenever thc sense of this
indenture so requires.
