THIS INDENTURE, made the 2n'~ day of December, Two Thousand Two

JOHN GOURVILLE and ANNE GOURVILLE, his wife, residing at 1430 Clearvicw Avenuc,
Southold, New York 11971
party ofthe first part, and
GENE CAIOLA and SHARI CAIOLA, husband and wife, residing at 27 South Pentaquit
Avenue, Bay Shore, New York 11706,
party of the second part,
WITNESSETH, that the party of thc first part, in comideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of thc second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Southold, in the Town of Southold, County of Suffolk 'and
State of New York, designated as Lot 4, on Map entitled, 'Map of Smithfield Park", filed in
the Suffolk County Clerk's Office on December 27, 1966 as Map Number 4770, which said
Lot is bounded and described as follows:
BEGINNING at a point set in the southwesterly side of Clearview Avenue distant 100.00 feet
northwesterly as measured along the southwesterly side of Clearview Avenue from the
intersection of the northwesterly side of Road and the southeasterly side of Clearview Avenue
and from said point or place of beginning;
RUNNING THENCE South 32 degrees 30 minutes 30 seconds West 2~1.75 feet;
THENCE North 57 degrees 29 minutes 30 seconds West 85.33 feet;
THENCE North 57 degrees 14 minutes 10 seconds West 14.66 feet;
RUNNING THENCE North 32 degrees 30 minutes 30 seconds East 251.66 feet to the
southwesterly side of Clearview Avenue;
RUNNING THENCE along the southwesterly side of Clearview Avenue South 57 degrees 29
minutes 30 seconds East 100.00 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parly of the first part by
deed dated 6112191 and recorded on 6/t8/91 in the Office of the Suffolk County Clerk in Liber
i 1282, Page 28.
TOGETHER with all fight, title and interest, if any, of the party of the first part in and to any
streels and roads abulting the above described premises to thc center lines thereof; TOGETHER
with the appurlenanees and all the estate and rights of thc parrot of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns ofth~ party of the second part forever.
AND thc party of the first pan covenants that thc party of thc first part has not done or suffered
anything whereby thc said premises have been cncumbcmd in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 oflhe Lien Law, covenants that
the par~y of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of lhe improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the ~me for any other purpose.
Thc word "pan~" shall bc constmad as if it read "parties" whenever thc sense of this indenture so
requires.
