party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN and 001100.

consideration paid by the party of the second part, does hereby grant and release unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying end being at Southold, in the Town of Southold, County of Suffolk and State of New
York, bounded and described as follows:
BEGINNING at a point on the westerly side of Gagen's Landing Road, said point being distant 120.59
feet northerly as measured along the westedy side of Gagen's Landing Road from the comer formed
by the intersection of the northerly side of Clearview Avenue with the westerly side of Gagen's
Landing Road and from said point of beginning;
RUNNING THENCE North 85 degrees 15 minutes 00 seconds West 156.01 feet to lands now or
formerly of Terp;
THENCE along said lands North 01 degrees 28 minutes 10 seconds East 81.73 feet to lands now or
formerly of Butkovich;
THENCE along said lands South 87 degrees 58 minutes 10 seconds West 149.93 feet to the westerly
side of Gagen's Landing Road;
THENCE along the westerly side of Gagen's Landing Road South 02 degrees 01 minutes 50 seconds
East 100.00 feet to the point or place of BEGINNING.
Together with the right to the use of a right of way in common with others over said proposed highway
from the northeasterly corner of the premises southerly about 220 feet to Clearview Avenue.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
dated 1117194, recorded 2/7/94 in Liber 11663 page 662.
Reserving to the party of the first part a life estate in/he premises.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above deacdbed premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and dghts of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
)art forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the pan'y of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
)art will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first [or the purpose of paying the cost of the improvement and will app;y the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party' shall be construed as if it reed 'parties' when ever the sense of this indenture so
requires.
