Akscin', which map was filed in the Office of the Clerk of the County of Suffolk on October 4, 2002 as Map #10838, more particularly bounded and described as follows: BEGINNING at a point on the Easterly end of a Private Road or Right of Way, 25 feet wide. which point is at the intersection of the most Westerly side of Lot 4 on said map and the Southerly line of Lot 3 on said map; RUNNING THENCE South 69 degrees 26 minutes 50 seconds East along the division line between Lots 3 and 4 on said map, 209.90 feet; THENCE North 21 degrees 34 minutes 40 seconds East still along the division line between Lots 3 and 4 on said map, 327.02 feet to land shown on Map of'Peilicano Woods'; THENCE South 69 degrees 26 minutes 50 seconds East along said last mentioned land, 261.43 feet to land shown on 'Map of Cedar Beach park'; THENCE South 22 degrees 24 minutes 30 seconds West along said last mentioned land 152.25 feet; THENCE South 22 degrees 16 minutes 40 seconds West still along/he land shown on "Map of Cedar Beach Park', 197.89 feet to land now or formerly of Akscin-Dehhan; THENCE North 69 degrees 26 minutes 50 seconds West along said last mentioned land, 470.34 I=eet to the Eestedy end of the PHvate Road or Right of Way above mentioned; and THENCE North 30 degrees 32 minutes 10 seconds East along the Easterly end of said private Right of Way. 23.35 feet to the point or place of BEGINNING. TOGETHER with an easement over the designated Private Road on part of Lot 1 on the above map. BEING AND INTENDED TO BE a part of the same premises conveyed to the parties of the first part by deed made by RAYMOND JAY AKSCIN dated 7/23199 and recorded on 7/28/99 in Lit)er 11978 at Page 816. SUBJECT TO the following covenants and restrictions which shall run with the land: 1. All houses will be a minimum of 3,000 square feet of finished heated living space above grade with a two- car garage, custom designed and built to suit in the 'Hampton Shingle Style Traditional" or 'English Country Homes' style and the design of which shell be approved by the grantors herein or by any homeowners' association hereinafter created. All houses shall have a finished stone driveway with Belgian block curbing, wood or masonry siding in natural or approved color stain, cedar shingle, slate or lifetime manufacturer's warranty roofing (no metal or tile roofing). Any porches and patios shall be of masonry construction (no decks). AIl chimneys shall be of masonry construction. There shall be no solid vinyl windows. AJJ accessory building locations and designs, all exterior doors including garage dooms (of wood construction only), exterior lighting, pools, fencing and landscape plans must be approved by the grantors herein or by any homeowners' association hereinafter created. Only gunita pools will be allowed (no vinyl lined pools). Construction must start within six months of the issuance of a building permit, with house designs and permit applications done with due diligence. The time within which to obtain a building permit for Lot Number 4 shall not begin to run until January 1, 2005. There shall be no removal of screen landscape material from any lot, all screen trees that die must be replaced within a reasonable time with trees of e minimum of fifty percent of the height of the dead tree. All landscaping must be adequately maintained. There shall be no outside clotheslines, no garbage cans visible from the road. no odor producing or emitting materials stored outside, no winter outside boat storage, no accessory apartments (either rented or for family use), no parking in the right of way as shown on the subdivision map, no more than one commercial vehicle with a gross weight of 10,000 lbs. shall be parked upon any lot. All roof runoff shall be contained in underground drainage systems; all landscape Irrigation shelf be from an irrigation well; all utilities shall be installed underground and all pool equipment must be enclosed. 7. There shall ~e a maximum of three domestic animals housed on any lot. There shall be no livestock. horses or other non-domestic animals housed on any lot. All animals must be kept inside et night. 8. All consb'uction must conform to New York State and Southold Town Building Codes. 9. Any mailbox shall be located et the Main Bayview Road entrance to the subdivision. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances end all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part. the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered In any way whatever, except as aforesaid. AND the party of the first part. in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word 'party' shall be construed as if it read 'parties" whenever the sense of this indenture so requires.
