THIS INDENTURE, made on May 16. 2002, between
Lois Voyticky, residing at 41 Eastern Parkway, Brooklyn, NY, 11238, Grantor, and
Judith F. Phinney, 19 Radcliffe Rd., Wellesley, MA 02462, Grantee,
WITNESSETH: That the Grantor, in consideration of Ten Dollars and other
valuable consideration paid by Grantee, does hereby grant and release unto the
Grantee, the heirs or successors and assigns of the Grantee forever,
All that certain plot, piece or parcel of land, .with the buildings and improvements
thereon erected, situate, lying and being' at Bayview, near Southold, in the Town of
Southold, County of Suffolk, State of New York, bounded and described as set forth in
annexed Schedule A, and known as 129-75 Main Bayview Road, Southold, NY.
TOGETHER with all right, title and interest, if any, of the Grantor in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the Grantor
in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the Grantee, the
heirs or successors and assigns of the Grantee forever.
AND the Grantor covenants that the Grantor has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the Grantor, in compliance with Section 13 of the Lien Law, covenants that
the Grantor will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying
the cost of the improvement and will apply the same first to the payment of the cost of
the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
Being and intended to be the same premises conveyed to the Grantor by deed
dated October 25, 2001 recorded November 2, 2001 in Liber 12151 page 124 in the
Suffolk County Clerk's office. Premises designated as District 1000 Section 088.000
Block 02.00 Lot 013.000.
IN WITNESS WHEREOF, the Grantor has duly executed this deed as of the day

ALL that certain plot, piece or parcel of land, With the buildings and improvements
thereon erected, situate, lying and being at Bayview, near Southold, in the Town of
Southold, County of Suffolk and State of New York, more particularly bounded and
described as follows:
BEGINNING at the comer formed by .the intersection of the easterly side of Midland
Parkway with the northerly side of Main Bayview Road;
RUNNING THENCE fi.om said point of beginning along the easterly side of Midland
Parkway north 24 degrees 46' 40" east 318.63 feet to the southerly side of Lot No. 1 as
shown on "Map of Seawood Acres, Section 1" filed No. 2575;
RUNNING THENCE along the southerly side of said Lot NO. 1 'south'67 degrees 46' 00"
east 137.0 feet to other land now or formerly of Adolph R. Trapp;
RUNNING THENCE along said land south 25 degrees 38' 10" west 324.74 feet to the
northerly sid~ of Main Bayview Road;
RUNNING THENCE along the northerly side of Main Bayview Road, north 65 degrees
13' 20" west 132.0 feet to the Comer aforesaid at the point or place of BEGINNING.
