Klieber as to one-half (1/2) interest, residing at 351 Berg Avenue, East Meadow, New York 11554 and to Margaret Ann Klieber-Schreck as to the remaining one-half ('/2) interest, residing at 158 Arnold Street, Holbrook, New York 11741 as Tenants in Common. party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL SEE SCHEDULE "A" ATTACHED TAX MAP NO. 473889 88.-5-47 TOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads abutting the above described premises to the center lines thereof; together with the appurtenances and all the estate and rights of the party of the first part in and to said premises; to have and to hold the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. AND the party of the first part covenants as follows: that said party of the first is seized of the said premises in fee simple, and has good right to convey the same; that the party of the second part shall quietly enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid; that the party of the first part will execute or procure any further necessary assurance of the title to said premises; and that said party of the first part will forever warrant the title to said premises. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires. IN PRESENCE OF: SCHEDULE "A" ALL 'that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Bayview, Town of Southoid, County of Suffolk, State of New York, known and designated as and by the Lot #53 on a certain map entitled "Map of Terry Waters at Bayview, Town of Southold, Suffolk County, N.Y." and filed in the Office of the Clerk of the County of Suffolk on December 29th,. 1958 as Map #2901. TOGETHER with an easement for ingress and egress over and upon Watersedge Way, Longview Lane, and Rambler Road for their entire distanCe as shown and laid out, 50 feet wide throughout, on said above mentioned filed map. RESERVING however to the Seller the title to the land in said roads and the right to herself, her grantees and successors in interest, to dedicate said roads as public roads, and to grant easements therein, for the construction and maintenance of public utilities. RESERVING also to the seller the right to change the location of said Rambler Road in any reasonable manner. TOGETHER with the right to use in common with other lot owners the area known as Lot #8 and the area adjoining next southerly thereto, to the extent of 80 feet more or less, of the northerly 80 feet of that parcel designated on said filed map as "Community Park and Beach (residents only)". TOGETHER with the right to use in common with other lot owners (said right being only for the benefit of the above described premises) for bathing and recreational purposes, the southerly 300 feet, more or less, of the parcel designated on the above mentioned filed map as "Community Park and Beach (residents only)". RESERVING however to the seller the right to change the location of the northerly boundary thereof as hereinabove provided.
