HEATH, residing at 1225 Sigsbee Road, Mattituck, NY, BRIAN HEATH, residing at 1225 Sigsbee Road, Mattituck, NY, DIANE HEATH KHORASSANI, residing at 104 West Hartsdale Ave., Hartsdale, NY and LAUREL HEATH SMITH, residing at 1010 Bay Avenue, Mattituck, NY and RONALD HEATH, residing at York Avenue, Lyndhurst, NJ as TENANTS IN COMMON as to an undivided one-sixth (1/6) interest each. parry of the second part, WITNESSETH, that the parry of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and Ixing in the at Mattituck in the Town of Southold, County of Suffolk and State of New York, nown and designated as and by Plot Number 82 on a certain map entitled, "Amended Map of Mattituck Park roperties, Inc., Mattituck, New York", said map being made by Daniel R. Young, P.E. and L.S. from actual urvey completed July 11, 1924 and filed-in the office of the Clerk of the County of Suffolk on the 12th day of anuary, 1926 as and by Map Number 801 (Abstract No. 368). TOGETHER with all rights and privileges, and subject to all convenants and restrictions contained in rior deeds of record. THE Grantor reserves the right to the exclusive use and occupancy of the premises during the rantor's lifetime,with the Grantor to pay for all maintenance and repairs, water and sewer charges, nsurance charges, and taxes relating to said premises. Said life use shall be personal to Grantor, and shall of be subject to assignment or lease, except as otherwise provided in this paragraph. The Grantor reserves he power to appoint the remainder and/or Grantor's life uses in the premises to any one or more of the issue f the Grantor, siblings of the Grantor, or issue of the Grantor's siblings, or the spouses or surviving spouses f any of the foregoing persons, with the term "issue" being deemed to include persons who have been dopted according to law but not born out of wedlock. This power shall be exercisable or may be elinquished during the Grantor's lifetime by a deed to the Grantee herein or to others who are members of he class of appointees set forth herein, making express reference to this power and executed and recorded n the County Clerk's office where this deed is recorded, prior to the Grantor's death. No exercise of this ower shall be deemed to release the Grantor's life estate unless such a release is explicitly made in a deed. he exercise of this power shall not exhaust it and unless the power is specifically released in such a deed, he deed recorded last shall control as to any ambiguities or inconsistencies. BEING AND INTENDED TO BE the same premises conveyed by Vincent J. Traynor and Barbara J. raynor, his wife, to the parties of the first part by deed dated June 9, 1956, recorded in the Suffolk County Clerk's Office on June 12, 1956 at Liber 4126, Page 270. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and loads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the parry of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the parry of the second part, the heirs or successors and assigns of the parry of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever,except as aforesaid.
