THIS INDENTURE, made the 6th day of March, Two Thousand Two
BETWEEN
ROBERTA A. WHITAKER, residing at 11 Willow Lane, Quogue, New York 11959,
party of the first part, and
GEORGE ROSENFELD and NANCy4ROSENFELD, husband and wife, residing at 69 Greene
Street, New York, New York 10012,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Bayview, Town of Southold, County of Suffolk and State of
New York, known and designated as and by the Lot 17 on a certain map entitled, "Map of
Terry Waters at Bayview, town of Southold, Suffolk County, NY" and filed in the Office of
the Clerk of the County of Suffolk on December 29, 1958 as Map //2901, being more
particularly bounded and described as follows:
BEGINNING at a point on the southerly side of Rambler Road Extension distant 1,265.61 feet
more or less northerly and easterly along the easterly side of Rambler Road and the southerly
side of Rambler Road Extension from the extreme westerly terminus of a curve which curve
connects the southerly side of Watersedge Way with the easterside of Rambler Road;
RUNNING THENCE along the southerly side of Rambler Road Extension and along the arc of
a curve having a radius of 325.00 feet a distance of 106.96 feet;
RUNNING THENCE South 30 degrees 23 minutes 40 seconds West 83.57 feet;
RUNNING THENCE South 28 degrees 28 minutes 30 seconds West 72.93 feet to the
northerly side of an unimproved boat basin;
RUNNING THENCE along the northerly side of an unimproved boat basis and along the arc
of a curve having a radius of 175.00 feet a distance of 90.34 feet;
RUNNING THENCE North 22 degrees 39 minutes 15 seconds East 150.00 feet to the
southerly side of Rambler Road Extension to the point or place of BEGINNING.
TOGETHER with an easement for ingress and egress over and upon Watersedge Way,
Longview Lane. and Rambler Road for their entire distance as shown and laid out, 50.00 feet
wide throughout on the said abovementioned filed map.
TOGETHER with the right to use in common with other lot owners the area known as Lot//8
and the area adjoining next southerly thereto, to the extent of 80.00 feet more or less, of the
northerly 80.00 feet of that parcel designated on said filed map as "Community Park and
Beach."
TOGETHER with the right to use in common with other owners for bathing and recreational
purposes the southerly 300 feet more or less of the parcel designated on the above mentioned
map as "Community Park and Beach."
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from James J. Campbell, dated November 30, 1988, and recorded December 6, 1988, in
the Office of the Suffolk County Clerk in Liber 10750, Page 515.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
