partyofthefirstpan, and EDWARD J. BOYD, residing at 3880 Paradise Point
Road, Southold, New York, 11971, as to a 9~ interest, and HELEN J.
ROSENBLUM, residing at 37E Westmoreland Drive, Shelter Island, New
York, 11965, as to a 2% interest, as tenants in common and as their
interests appear,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the
party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever,
ALL thatcenainplot, pieceorparcelofland,' ~ ,~'~r~,situate, lying~d~gk~m
at Bayview, Town of Southold, County of Suffolk, State of New York,
known and designated as and by Lot. No.68 on a certain map entitled,
"Map of Terry Waters at Bayview, Town of Southold, Suffolk County,
N.Y." and filed in the office of the Clerk of the County of Suffolk
on December 29, 1958 as Map ~2901.
TOGETHER with the right to use in common with other lot owners the
area known as Lot No.8 and the area adjoining next southerly thereto
to the extent of 80 feet, more or less, being the northerly 80 feet
of the parcel designated on said filed map as "Community Park and
Beach (Residents Only)."
TOGETHER with the right to use in common with other lot owners (said
right being only for the benefit of the above-described premises) for
bathing and recreation purposes, the southerly 300 feet, more or less,
of the parcel designated on the above-mentioned filed map as "Community
Park and Beach (Resident Only)."
SUBJECT TO the rules, regulations and charges which may be adopted from
time to time by the Terry Waters Property Owners Association, Inc., for
the maintenance and repair of roads, basins, canals and "Community
Park and Beach."
BEING AND INTENDED To BE the same premises conveyed to the party of
the first part by deed dated March 20, 1971, and recorded in the
office of the Clerk of the County of Suffolk on March 25, 1971 at
Liber 6904 page 515.
TOGETHER with all fight, title and interest, if any, of the party of the first part o~ in and to any s~eets ~d roads abutting the
above-described pm~ses to the center lines thereof; TOGETHER with the appurtenances and all the estam ~d fights of the
pa~y of the first p~ in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the
second part, the heirs or successors and assigns of the party of the second part ~rever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said
premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above written.
