RE1DY, at 59 East Madison Street, East Islip, New York 11730, as Surviving Co-Trustees of the JAMES E. REIDY 2000 REVOCABLE TRUST, Agreement of which is dated December 18, 2000. Party of the First Part, and /' ,. d?_ JOANNA LANE, residing at 2960 Clubhouse Road, Merrick, New York Party of the Second Part, WITNESSETH, that the Party of the First Part, in consideration of the sum of Six Hundred Thirty Thousand Dollars ($630,000.00) and other valuable consideration paid by the Party of the Second Part, does hereby grant and release unto the Party of the Second Part, the heirs or successors and assigns of the Party of the Second Part forever, ALL that certain plot, piece or parcel of land, with buildings and improvements thereon erected, situate, lying, and being in the Town of Southold, County of Suffolk, State of New York, bounded and described as follows: BEGINNING at a point on the Easterly line of a right of way about 30 feet in width, at the Southwesterly corner of land now or formerly of Peter Bogovic, said point being South 00 degrees 16 minutes 20 seconds East, 122.05 feet from the Southerly line of North Road to Bayview; RUNNING THENCE along said land now or formerly of Bogovic, South 82 degrees 00 minutes 00 seconds East, 340 feet, more or less, to ordinary high water mark of Goose Creek; THENCE Southerly and then Westerly along said high water mark, 480 feet, more or less, to other land now or formerly of Daniel T. Smith and George Herbert Smith (lot #2); THENCE along said other land, two courses: (1) North 9 degrees 00 minutes 00 seconds West, 190 feet, more or less; (2) North 69 degrees 00 minutes 00 seconds West, 300 feet to the Easterly line of said right of way; THENCE along said Easterly line, North 00 degrees 16 minutes 20 seconds West, 100 feet to the point of BEGINNING. TOGETHER WITH the use ora right of way (in common with others) 30 feet in width over land now or formerly of Daniel T. Smith and George Herbert Smith from the Southwesterly corner of the premises Northerly about 222 feet to North Road to Bayview. The said right of way being for purpose of ingress and egress from premises to North Road to Bayview and from North Road to Bayview to said premises, and for the purpose of installation, maintenance and repair of utility lines, pipes, conduits below, on the surface and/or above the surface of said right of way in such manner as not to interfere with pedestrian or vehicular traffic on said premises. SUBJECT TO the existing 5 foot water main easement along the Easterly 5 feet of said right of way. TOGETHER WITH an easement five feet in width (in common with others) including the right of installation, maintenance, repair and replacement of one well and underground water lines and pipes for the purpose of pruviding water supply to the premises herein, on, through and over the following described property: AND the Party of the First Part, in compliance with Section 13 of the Lien Law, covenants that the Party of the First Part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "Party" shall be construed as if it read "Parties" whenever the sense of this indenture so requires.
