THIS INDENTURE, made the 3rd day of Angust nineteen hundred and ninety-eight
BETWEEN
PAULETTE GARAFALO, residing at 315 East 72"d Street, Apt. I IA, New York, NY 10021
party of the first part, and
THOMAS E. GIESE, residing at 315 East 72"d Street, Apt. I IA,New York,NY 10021
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
twenty-five (25%) percent of her seventy-five(75%) percent interest in and to
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being at Nassau Point or Little Hog Neck in the Town of Southold, Suffolk
County, State of New York, known and designated as Lot No. 4 as shown on a certain map
entitled, "Map of Proposed Subdivision of Section A, Nassau Point Club Properties, Inc.,
surveyed by Wallace H. Halsey, Southampton, New York, June 7, 1919, and filed in the
Office of the Clerk of the County of Suffolk on 8/16/22 as Map No. 156, bounded and
described as follows:-
BEGINNING at a point on the easterly side of Nassau Point Road where said road is
intersected by the dividing line between Lot No. 3 and Lot No. 4;
RUNNING THENCE North 78 degrees 36 minutes 20 seconds East along said dividing line, a
distance of 382 feet to the average high water line of Hog Neck Bay as of May 14, 1997;
RUNNING THENCE along the said high water line South 04 degrees 47 minutes 20 seconds
West, 100.20 feet to Lot 5 on the said filed map;
RUNNING THENCE along said dividing line between Lot No. 4 and Lot No. 5, South 78
degrees 36 minutes 20 seconds West a distance of 371 feet to a point where said latter dividing
line intersects the easterly side of Nassau Point Road;
RUNNING THENCE along the easterly side of Nassau Point Road a distance whose tie line
connecting the said latter point with the point where said easterly side of Nassau Point Road is
intersected by the dividing line between Lot No. 3 and Lot No. 4 is North 11 degrees 05
minutes 30 seconds West a distance of 99.54 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
and Thomas E. Giese by deed dated from Robert J. Winchester and Patricia H. Winchester,
his wife, dated May 22, 1997, and recorded in the Suffolk County Clerk's Office on May 30,
1997, in Liber 11832 page 982.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
