WITNESSETH, that the party of the first part. to whom SEAN M. DELEHANTY letters
testamentary were issued by the Surrogate's Court. Suffolk County, New York on the 16th day of Januaty 2004
and by vLrtue of the power and authority given In and by said last will and testament, and/or by Article 11 of the
Estates, Powers and Trusts Law, and in consideration of a bequest, does hereby grant and release unto the patty
of the ,second part. the distributees or successors and assigns of the party of the second part forcer, r,

situate, lying and being in the
Village of Greenport, Town of Southold, County of Suffolk and State of New York, being more
particularly bounded and de_scribed as follows:
BEGINNING at a point on thc easterly line of Fourth Street, 200.00 feet northerly along said easterly line
from Flint Street said point of beginning being the southwest comer of land n/oK of John F. A. Kalhert, Trustee.
and from said point of beginning;

feet to land n/o/f of Burden;
RUNNING THENCE along said land n/oK of Burden north 82 degrees 48 minutes 40 seconds west
140.00 feet to the point of place of BEGINNING.
TOGETHER WITH a right of way for ingress and egress oxv, r the said 15 foot wide right of way
adjoining the aforementioned property to the north and running from the northwesterly corner of the premises
herein described easterly t65.00 feet more or less to Greenport Harbor and ingress and egress to a parcel 65 x 50
feet at the end of said right of way as per Lihet 7707 cp 516.
TOGETHER with all right, tide and interest, if any, of the party of the first part in and to any streets
and roads abutting the abo~-deseribed premises to the centerlincs thereof.
TOGETHER with the appurtenances, and also all the estate which the said decedent had at thc time of
decedent's death in said premises, and also the estate therein, which the party of the first part has or has powex
to convey or dispose of, whether individuaBy, or by vLrtue of said will or otherwise,
TO HAVE AND TO HOLD the prrmises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the p_arty of the first part covenants that the party of the first part has nc~ done or suffered
anything whereb'y the said premises have been en.c. umbered in any way whatever, except as aforesaid.
AND the party of the fkst part, in compliance with'S~etion 13 of the.llen Law, covenants that the party
of the first part will receive the consideration for this conveyafice an~i will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the costs of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same
for any other purpose.
Together with a right m use in common with others the parcel of beach at the end of tho
aforementioned fight-of-way on Greenport Harbor, of an area 50.00 feet, mom or less,
along Greenport Harbor by 65.00 feet, more or less, in d~th.
Together with a fight to use in common with others, the sewer and water mains running
along thc 15 foot right-of-way adjoining thc subjcct property to thc North, which sewer
and water mains have bccn installed in conformity with thc rules and regulations of the
Village of Grccnport and which sewer and water mains have been dedicated to the
Village of Grccnport.
The word 'party' shall be construed as if it read 'parties' xvhencver the sense of this indenture so
requires.
